Merit Appeals Board July 18, 2022 hearing. And the Board would like to address these concerns at a later date. And, to me, as the Chair, it becomes a housekeeping measure as to how do we do that. So, we would appreciate your guidance so that we can be legally—okay, we don't violate any Sunshine laws—how do we address our concerns by placing it on future agendas or can we ask questions in part as the result of our director's report that's going to be made in a little bit. How do we do that? MR. YOSHIMOTO: Okay. Before I address the question, we the Board currently has the before it, agenda Item number 5. So, I would recommend we take care of that first, right, before—to keep the order. CHR. CABANAS: Okay, sure. Thank you so much. Okay. So we are in an open session and following up with Number 5—communication—which dealt with the issue as to whether the Board has jurisdiction to hear appeal regarding Communication 22-04. I would like to entertain a motion to concur with the recommendation that was made in the closed hearing. So, may I have a motion to concur with the recommendation made in the closed hearing. MS. MATHEWS: So moved. CHR. CABANAS: Thank you. MS. DE SOTO: Second. CHR. CABANAS: Thank you, Gay and Kate. Motion made and seconded to concur with the recommendation made in the closed hearing pertaining to the appeal regarding Communication 22-04. Is there any discussion?
