significant and required additional mitigation in the form of preservation and data <br /> recovery. SHPD accepted the AIS and agreed with the significance determinations but <br /> did not provide a finding of no effect because the proposed mitigation needed to be <br /> solidified. Conditions of the ordinances required the creation of data recovery and <br /> preservation plans for the significant, which to our knowledge have yet to be complete. <br /> While repeal of the ordinances would relieve the landowners of this immediate <br /> requirement, any subsequent subdivision and significant land alteration would trigger <br /> historic review under HRS 6E-42, including the possible requirement for updated <br /> archaeological studies and mitigation. <br /> As the most makai point of the project area is located over two miles from the <br /> nearest shoreline, the project area is not situated within the Special Management Area. <br /> There is no known public access to the shoreline or mountains that traverses the project <br /> area and no known cultural resources/practices associated with the project area. Formal <br /> flora and fauna studies were developed as part of the environmental assessment for the <br /> original project, and while they identified native and endemic animal and plant species, <br /> none were listed or endangered. <br /> While the requested repeal will extinguish any conditions related to the rezone <br /> ordinances, the areas encumbered by conservation easements will be subject to the <br /> conditions and limitations found therein. Furthermore, the current or subsequent <br /> landowners will be responsible for developing the remaining land area parcels in <br /> compliance with all applicable governmental requirements in connection with any use <br /> permitted in the A-20a zoning district. Failure to comply with such requirements will be <br /> considered a violation that may result in enforcement action by the Planning Department <br /> and/or other affected agencies. <br /> Based on the preceding findings, a favorable recommendation of the Planning Director's <br /> initiated action to repeal Change of Zone Ordinance No. 95 70 and No. 98 63 and reclassify <br /> lands from Agricultural 1-acre (A-la),Agricultural 3-acres (A-3a), Agricultural 200-acres <br /> (A-200a),Agricultural 255-acres (A-255a), and Agricultural 8,000-acres (A-8000a) to their <br /> original,Agricultural 20-acres (A-20a)zoning district would result in an appropriate land use <br /> pattern and would be in the best interest of the general public. <br /> 4 <br />
