January 19, 2023 <br /> Cindy Freitas <br /> makainangiOgmail.com <br /> County of Hawaii <br /> Leeward Planning Commission <br /> AGENDA <br /> RE: Item 3,Applicant Charles &Ann Stevenson and John Fumo (PL—REZ -2022-000035) <br /> He Mele komo a he mele aloha no na kupuna o ke au i hala Aloha mai kakou. <br /> Aloha, <br /> My name is Cindy Freitas and I'm a Native Hawaiian descended of the native inhabitants of Hawai'i <br /> prior to 1778 and born and raised in Hawai'i. <br /> I am also a practitioner who still practice the cultural traditional customary practices that was instill in <br /> me by my grandparents at a young age from mauka(MOUNTAIN TO SEA)to makai in many areas. <br /> I OPPOSE Item#3 for the following reasons: <br /> 1. The area consist of federally endangered Hawaiian hoary bat, Hawaiian Hawk, akepa and Hawaiian <br /> creeper above the 3000 foot elevation contour as "essential habitat". Which falls under the Endanger <br /> Species Act <br /> 2. There is no Archaeological and cultural study was conducted of the property due to previously <br /> impact by ground-disturbing activities associated with residential development. No archaeological <br /> inventory survey has been conducted with in the subject parcel and no historic properties have been <br /> previously identified. However State Historical Preservation Division request the opportunity to <br /> review future permits for the subject property. Hawaii Revised Statue 6E-42 Review of proposed <br /> projects (Agricultural 20 acres). <br /> (a) Before any agency or officer of the State or its political subdivisions approves any project <br /> involving a permit, license, certificate, land use change, subdivision, or other entitlement for use, <br /> which may affect historic property, aviation artifact, or a burial site, the agency or office shall advise <br /> the department and prior to any approval allow the department an opportunity for review and comment <br /> on the effect of the proposed project on historic properties, aviation artifacts, or burial sites, consistent <br /> with section 6E-43, including those listed in the Hawaii register of historic places. <br /> Mahalo <br /> /s/ <br /> Cindy Freitas <br />
