So you submitted oral testimony, I m <br />but he won't be available for cross-examination? <br />VITOUSEK:That's correct. The written testimony was submitted, a <br />correct statement, and it's Fielding Schultz. Keone Schultz is an associate in our office. <br />TORIGOE:Oh, Fielding Schultz, okay. <br />VITOUSEK:Fielding Schultz. <br />TORIGOE:Sorry. I think we need to get clear on the record before we end <br />your case the parties' positions on that, you know, if -. Are y <br />expecting the panel to take into account or consider Mr. Schultz' written testimony <br />without cross-examination? <br />VITOUSEK:We are offering his testimony. Yes, we've offered his written <br />testimony, and that's, and so obviously if a party has a position on that, that' s something <br />the Commission's going to have to decide. <br />GIFFIN:The Applicant's representative did say that if there was anyone who <br />had any questions regarding that, that he would refer those questions to the Applicant <br />himself, correct? <br />VITOUSEK:That's correct. And I understand, I mean the point is well taken, <br />Mr. Torigoe, and it's just something that the Commission is going to have to decide. And <br />if I don't, if the witness isn't here, has submitted written testimony, that becomes an issue <br />for the Commission as far as I'm concerned. I'm not going to wi <br />ISHADO:Madam Chair, if -? I'm sorry. <br />GIFFIN:Mr. Ishado. <br />ISHADO:If I could state the County's position on that. You know, there has <br />been some concern expressed at the previous hearings on the, I guess the landscaping, the <br />effect of the visual sites, use of the trees to shield the area. So we do have questions for <br />the, for Mr. Schultz, you know. We won't object to the introduction of his written <br />testimony, but we'd like to state we do have concerns about cross-examination; and only <br />because, you know, this was brought up at the hearing. <br />6 <br /> <br />
