If, on the other <br />hand, the Commission wanted to set it for, wanted to take further action, then I think the <br />Commission would refuse to accept the Department’s order, recommendation, and then <br />set this for further action; and that would be the procedure here. <br />SPRINGER:So the motion would be to receive the staff report? <br />YUEN:Yes. <br />FUJIKAWA:Okay. You want to state your name and your address, and <br />then we go to you? <br />VAN DE CAR:My name is Diana Van De Car. I’m the attorney for the <br />Applicants. My address is 101 Aupuni Street, Suite 238. <br />FUJIKAWA:Thank you. You? <br />BENSON:My name is Jay Benson. I’m the son of owners, co-owner, Hilo <br />Oceanfront Bed and Breakfast. I reside at the bed and breakfast, 1923 Kalanianaole, <br />Hilo. <br />FUJIKAWA:Thank you. Diana, you may proceed. <br />VAN DE CAR:I believe everything that was requested of the Applicant has been <br />complied with. There was a request that a permanent roof be installed over the bed and <br />breakfast to shield, visually shield the hot tub from the sight of the neighbors next door. <br />That proved to be prohibitively expensive; and so, as a compromise, they just simply <br />removed the hot tub to take care of that problem, which I think was a good step that the <br />Applicants took. And all other conditions have been met, so I’d like to ask that, I guess <br />4 <br /> <br />
