WATANABE: We could get into a lot of he said, she said, this happened, whatever. <br />What I’m, to be honest with you, so that we can hopefully finish today, what I’m more interested <br />in is, okay, will it really affect the environment? Today, we had an opportunity that was not <br />available prior to this, where apparently at least an approximation of the shoreline was <br />established at a 3.2-foot tide irrespective of what has gone on in the past. Yeah? We did <br />measure that, and it’s clear that we have more than 40 feet to wherever your building would <br />occur. I’m assuming residential setbacks, the front is like 15 feet and side pin? Is that correct? <br />YEH: I believe so. <br />WATANABE: And you’re planning to do 15 regular setbacks, 15 and 10 sides. So, it <br />kind of addresses what Ms. Siracusa was saying. If you had the survey, would it change <br />anything? If we can focus on that, then maybe this would be less of a trial than, you see what <br />I’m saying? <br />SULLIVAN: Right, yes. <br />WATANABE: Yeah, so I’m more concerned about how do we go forward rather than <br />where have we been. <br />SULLIVAN: What I’ve gone through? <br />WATANABE: Yeah. <br />SULLIVAN: What it’s been like for the last four years. <br />WATANABE: Yeah. Really, and I’m hoping that we can resolve this that way. I’m <br />hoping. <br />SULLIVAN: Let me, Chris Yuen sent me a letter that said that he was, like we already <br />know, he was going to send the information to you, okay, which he never did and that I needed <br />to follow certain rules. One of those rules said I had to apply for a Major use permit before I <br />could even, even contact you. I didn’t understand that. I let it fly. I finally contacted the <br />surveyors in January of 2008, 7 rather. Hold on, I’ll do this quickly. We were told that we <br />didn’t have land that abuts the road, abuts the water, so there was no need to do a survey. I <br />contacted them again in June. The topo letter that you see is the beginning of a shoreline survey. <br />Chris Conger from DLNR, and Niels Christensen of Independent Hawaii Surveyors were out on <br />our property in October after he had drawn that map. They got out to the land. There was, it was <br />2.87 high tide. There was no water anywhere near our property. Chris Conger said, told, I’m <br />doing hearsay here, this is what Niels told me, that he said there’s no water on their land, they <br />don’t need it at this point, and then he went back. And you’ll see then he raised the rate at that <br />point after he was on our lot. That’s why we don’t have a shoreline survey, is because Niels sent <br />our money back and he said I can’t do it until the County and the State get this thing figured out, <br />I can’t give you a shoreline survey because the County is saying 2.8, the State is saying 3.25. <br />And I got my – and there’s a copy of that letter in with your files. Okay? Now, they went out, <br />the point I’m trying to say is that they went out on our lot and that’s when the rules changed. <br />YEH: Let me, let me just try, this will be real quick. <br />21 <br /> <br />
