this because we were intending not to include agricultural tourism as part of the special permit, <br />they had informed the Planning Department that they did not feel at this time they could meet the <br />minimum criteria to be a permitted use under the agricultural tourism section. So at that point <br />we needed to include that particular request within the special permit. Again, it also states, as <br />you had mentioned, that these overnight accommodations and weddings that are also requested <br />by the applicant do require the special permit, as well as any type of church or temple activity. <br />So in a sense even though there are multiple requests, theyÓre all coming together under one <br />special permit request. WeÓre trying to address each of the issues in the conditions. Usually we <br />donÓt see too many special permits that come before the Planning Commission with so many <br />requests. And so weÓre trying to be creative in addressing all the possible impacts that can occur <br />from each of the different areas. <br /> <br />DOMINGO: So, in essence, in approving this special permit weÓre actually exempting <br />the applicant from these requirements as contained in the Zoning Code? <br /> <br />DARROW: Correct. <br /> <br />DOMINGO: WeÓre exempting it? <br /> <br />DARROW: I donÓt know if you would, what the term exempt means. But if they donÓt <br />meet that criteria itÓs okay because they have a special permit. If they do, thatÓs okay, they still <br />have a special permit. But at this time if they get to a position maybe, I donÓt know even know if <br />they would be able to because of the fact that in the Code it states that if they do have overnight <br />accommodations associated with this activity, they need the special permit. So there is the <br />possibility that if they start to comply with the agricultural criteria mentioned in Subsection ( <br />that maybe they may not need a special permit anymore. But that can, maybe at some point they <br />can amend the permit to be able to come in and say weÓd like to delete the special permit <br />requirement for the ag tourism because weÓre meeting all those criteria; and then they would just <br />have the permit for the overnight accommodations as well as the <br /> <br />DOMINGO: I see. Well, you know, Mr. Darrow and Members of the C <br />asking these questions only because in the event that we have a bonafide farmer established <br />already wanting to establish an ag tourism district then in essence he would be required to meet <br />all of these requirements. And as I look at these requirements, you know, it sometimes seems to <br />be impossible for anyone to meet these because of having over Ðx <br />anticipating ÐxÑ number of visitors a year. Was it 30,000 or so? <br /> <br />DARROW: I think thatÓs the maximum. <br /> <br />DOMINGO: Yeah. <br /> <br />DARROW: So that would be quite a bit of activity occurring on the property. <br /> <br />DOMINGO: Thanks.
