AMENDMENT TO SPECIAL PERMIT NO. 842 <br /> KE'ALOHA LANI, LLC (FORMERLY HAWAI-I BREWERY <br /> DEVELOPMENT CO. INC.) <br /> KEAAU, PUNA, HAWAIA <br /> TAX MAP KEY: (3) 1-6-141: 024, 027, 028 <br /> I. INTRODUCTION <br /> Ke'aloha Lani, LLC (hereinafter referred to as either "applicant"or"KAL') <br /> purchased the subject properties through an Agreement of Sale from <br /> Hawaii Brewery Development Co. Inc. The subject properties were issued <br /> a Special Permit (SPP 842) for a water, brewery, and soft drink complex <br /> on May 27, 1993. (Exhibit A) Condition 4 required occupancy of one of <br /> the facilities before October 18, 2023. Although the project is underway, <br /> its occupancy before that date is problematic, and thus, the applicant is <br /> seeking a time extension of this condition. <br /> II. PROJECT LOCATION <br /> The subject area is located generally east of the Volcano Highway and <br /> (Highway 11) and north of the Keaau-Pahoa Bypass Road (Highway 130). <br /> The town of Keaau is located approximately 1 mile to the south. (Figure 1) <br /> Surrounding land uses include a papaya packing plant, the former Keaau <br /> Kim Chee factory, a cabinet shop, and scattered residences. There is a <br /> property less than 1,000 feet from the subject area that was rezoned to <br /> FA-1a. <br /> As will be explained below, the affected area, consisting of 7+ acres, is <br /> part of an original 14.5- acre area that was initially issued a Special <br /> Permit. The 7+ acre site has since been subdivided into three (3) lots. <br /> (Figure 2). <br /> III. PERMITTING BACKGROUND <br /> Hawaii Brewery Development Co. Inc. ("HBDG') <br /> • applied for and received a Special Permit (SPP 842) by the Planning <br /> Commission on May 27, 1993, to establish a brewery, water, and soft <br /> drink bottling facility and related improvements on 14.5+ acres of land. <br /> Subsequently, a water bottling facility was established on 7+ acres of <br /> the original acreage. <br /> • because the brewery and soft drink bottling components on the <br /> remaining 7+ acre portion were not completed within the required time <br /> period conditioned by the Special Permit, requested and received a 5- <br /> 1 <br />
