Department. DPW and ITE recommendations are so far being ignored by the Planning <br />Commission or by the Planning Department I guess in this case with this, the Planning <br />Department recommendation. If an injury or a fatal accident occurs at that location after the <br />DPWs recommendations have been ignored you know I think well all have blood on our hands <br />and Im really not sure what kind of liability the whole County is accepting by doing that. And <br />as a taxpayer certainly I would rather not see the County accept that liability. So in closing I <br />think we have maybe a request for the Commissioners today to consider 4 options for this <br />application. The first one is to approve it as it is. There are I believe basis for appeal here and if <br />this is the last time you know were going to come before the Commission then its possible that <br />an appeal would be filed if that was the case. The second is to deny the application as it stands. <br />And I think theres 2 options that are compromises and Mr. Haney talked about these in length <br />and probably the best one is to change condition 3 to include the DPW recommendations. We <br />really do think that there is room there to do this. There is already going to be some dismantling <br />of structures in the area. Theres already going to be some vegetation cut down and wed really <br />liketoworkwiththedeveloperandwiththeDPWtoputasafedrivewayin.Thefourth <br />possible option is just to continue the hearing again. Well like Mr. Mooers said weve been here <br />8 times already. If it could be continued and we could work out those details in the next month <br />with the developer I think everybodys concerns will have been addressed. I just have this last <br />little thing to say and I want to thank the people of Hawai¡i for showing me aloha spirit. I think <br />aloha spirit invites everyone to come here. Ive been told well wheres your aloha spirit why are <br />you being so mean to this guy and that started with Soto and not with Huggett. Well you know <br />the aloha spirit I think it works both ways and it means that people who want to join the <br />community can do so but they need to respect the rights and the safety of the people that are <br />already here. Commissioner Siracusa? <br />SIRACUSA:Several things Im trying to remember all the points you made when I <br />wanted to say something. Yeah, for your information in the new revision of the <br />recommendations on page 6 starting with line 1, 2, 3, 4, 56. Sixth line from the top and this is <br />underscored because its a ramsayered version recommends that an archaeological monitor be <br />present prior to ground disturbing activities in the effected area on the parcel. So it would appear <br />that that concern of yours is already incorporated. <br />BUSCEMI:Could I ask if that would be a Hawai¡i County monitor or would that be? <br />SIRACUSA:It does not specify. Usually I believe that those monitors are from the <br />DLNR Historic Preservation. Would the Director address that please? <br />YUEN:Historic Preservation has standards for who can be an archaeological <br />monitor. We do not have any such persons on staff. So they are people that are retained by <br />private parties however DLNR does specify what qualifications they have. <br />SIRACUSA:Thank you.
