Leeward Planning Commission through the Planning Director on this request for a five- <br />year time extension to complete construction. <br />In response to the Commissioners’ inquiries, Ms. Newlon clarified that the reason for this <br />request is because unforeseen economic conditions have delayed progress of the <br />proposed restaurant expansion, and also their financing commitment has been deferred <br />pending an improved economy. <br />Applicant Presentation <br />The applicant’s representative, Eric von Platen Luder, introduced himself as president of <br />Olu Kai, Ltd. <br />At this time Commissioner Harris-Glade stated that he was part of a team who responded <br />to the applicant’s request for proposal for the subject project about a year and a half ago, <br />but currently there is no contract. He then asked Mr. von Platen Luder whether the <br />design will remain the same. Mr. von Platen Luder responded that although the building <br />envelope and height will remain the same, there will be modifications to the previously <br />submitted plan as it was very preliminary. It was then agreed by all in attendance that <br />Commissioner Harris-Glade’s status does not constitute a conflict of interest, and that he <br />can participate fully in discussion and action on this item. <br />Mr. von Platen Luder confirmed in response to Commissioner Ross’s question, that he <br />understands and intends to submit a final design to the Commission for its review and <br />approval. <br />In response to the Commissioners’ inquiries, Mr. von Platen Luder said that the gray <br />color specified in the plan was dictated by the Commission at that time, and that their <br />intention is to pick a color that will make the building blend in with the surroundings as <br />much as possible. <br />Commissioners also asked about the tent-like roof structure shown on the previously <br />submitted plan. Mr. von Platen Luder said that the material is tightly stretched fabric and <br />the design concept is to get the effect of sail. <br />Action <br />It was moved by Commissioner Ross, and seconded by Commissioner Coats, to send a <br />favorable recommendation to the Planning Director, with the following condition: <br />The applicant shall submit a final design to the Kailua Village Design Commission <br />for its review prior to Final Plan Approval. <br />A roll call vote was taken and the motion carried with seven ayes (Ross, Coats, Bleck, <br />Harris-Glade, Herbert, Kern and Ogin) and one absent and excused (Au Hoy). <br />2.Review of an application to be considered before the next Leeward Planning Commission <br />meeting; a Special Management Area Use Permit Application (SMA 09-000032) for <br />2 <br /> <br />
