YUEN:The first thing he would have to do before developing a <br />subdivisiontherewould be he would have to improve Church of God Road with a 50- <br />foot right-of-way with a 20-foot pavement. That would require him buying property <br />from the lot that is mauka of him and widening, and then widening the rest of the roadon <br />his side of the road. So thats both a difficult and expensive proposition. <br />WILSON:So, in other words, he would have to all the way, my lot is Lot No. <br />2, he would have to approach us to have some portion of our road, of our lot as well as <br />some portion of his property to accommodate that widening and make that intersection -? <br />YUEN:He could do it all on his side of the road. <br />WILSON:Would that be a requirement? <br />YUEN:If you dont want to sell him part of your property, you dont have <br />to. <br />WILSON:Iunderstandthatpart. <br />YUEN:Sothisisanalternativeforhimbutitsnotaverypractical <br />alternative. <br />FUJIKAWA:Robert? <br />WHITMYER:The biggest concern that I have, its always, its the same old thing <br />nowadays, its, your definition of what is; and it gets kind of tiring after awhile. But the <br />biggest problem that I have is they built Hualalai Vistas, they allowed Tom Smith to <br />develop his property, they have a wonderful entrance and exit on the highway and his <br />road connects with theirs, and his road runs right up to ours, and then they dont let us use <br />it anymore. Thats the biggest problem that I have because weve been there already. <br />Okay? Youve met all the requirements of Hualalai Vistas, youve met all the <br />requirements of everything else. And for some reason Ive been there when theres <br />boulders as big as my car on the street and you cant drive through it anymore because <br />the people are pissed at you. Its ridiculous. I dont want to be in that place ever again. <br />As long as you, if you made me feel comfortable that Im not in that kind of position <br />anymore, you know, were not having this conversation. Thats it. <br />YUEN:I understand your frustration on the prior experience that you had. <br />I dont know anything about the background of that or the legalities of that, except that a <br />judge ruled contrary to you. However, the condition of rezoning of Hualalai Vistas <br />requires that road to be dedicated to the County at no cost upon request. Thats a matter <br />of law. <br />WHITMYER:The connection to our road, also? Not to interrupt you but thats <br />the main thing Im wondering. <br />23 <br /> <br />
