9. Prior to the expansion of client occupancy beyond 8 clients, the Applicant shall install, construct, and maintain improvements for Fire Department Access Road (FDAR) access to the subject property and fire suppression improvements on the subject property, including but not limited to on-site water storage, as required by the Fire Department. Upon successful completion of the improvements and prior to the commencement of the proposed use, the applicant shall provide the Planning Department documentation from the Fire Department that the improvements meet Fire Code standards. 10. The Applicant shall provide potable water from a system approved by the State Department of Health to the Special Treatment Facility. 11. All development-generated runoff shall be disposed of onsite and shall not be directed toward any adjacent properties. 12. All earthwork and grading shall conform to Chapter 10, Erosion and Sediment Control of the Hawaii County Code. 13. In the event that surface or subsurface historic resources, including human skeletal remains, structural remains (e.g. rock walls, terraces, platforms, etc.), cultural deposits, marine shell concentrations, sand deposits, or sink holes are identified during the demolition and/or construction work,the Applicant shall cease work in the immediate vicinity of the find, protect the find from additional disturbance and contact the Department of Land and Natural Resources-State Historic Preservation Division (DLNR-SHPD) at(808) 933-7651. Subsequent work shall proceed upon an archaeological clearance from DLNR-SHPD when it finds that sufficient mitigation measures have been taken. 14. Comply with all applicable County, State and Federal laws, rules and regulations and requirements. 15. Should any of these conditions not be met or substantially complied with in a timely manner, the Director may initiate procedures to revoke this Special Permit. -12-
