already developed portion of the larger 29.63-acre parcel for the proposed use. So,while <br /> a portion of the property will be used for non-agricultural uses, the overall agricultural <br /> potential of the subject property will not be diminished. <br /> Currently,the permit area includes some ornamental and fruit trees, and the <br /> applicant proposes to expand agricultural uses of the property by planting Rambutan <br /> orchard and developing a 600-square foot greenhouse for vegetable cultivation, thus <br /> agricultural uses on the subject property will continue. Therefore,the proposed use will <br /> not adversely affect the preservation and agricultural use of prime agricultural lands and <br /> is not contrary to the objectives sought to be accomplished by the State Land Use Law <br /> and Regulations. <br /> The proposed use is an unusual and reasonable use of land situated within <br /> the State Land Use Agricultural District. In recognizing that lands within agricultural <br /> districts might not be best suited for agricultural activities and yet classified as such, and <br /> in recognition that certain types of uses might not be strictly agricultural in nature,yet <br /> reasonable in such districts, the legislature has provided for the Special Permit process to <br /> allow certain unusual and reasonable uses within the Agricultural district. <br /> The subject, 29.63-acre property is located approximately '/2 mile west(mauka) of <br /> Highway 19 in Umauma. The 3.03-acre permit area is improved with an existing, <br /> permitted, 7,351 square foot, 2-story, 5-bedroom, 3 1/2 -bathroom dwelling built in 2002 <br /> and with various permitted additions and alterations in the years thereafter. The permit <br /> area is also improved with a 1,620 square foot,permitted steel, Quonset-style agricultural <br /> storage shed built in 2004. These improvements have been used since 2019 as part of a <br /> permitted Special Treatment Facility under license of the State Department of Health. <br /> Continued use of this area and improvements for the same use, but with more clients, is <br /> unusual in that it is not agricultural in nature; however, it is also reasonable to continue <br /> the use as the impacts of the expanded clientele will be negligible to the use of the <br /> property. Additionally, the applicant plans to continue existing agricultural use of <br /> property and expand it in the future. <br /> Based on the preceding, the subject request is considered an unusual and <br /> reasonable use of the agricultural land. <br /> -3- <br />
