FUKE: —because— <br /> DEFRANCO: because you are not allowed. <br /> FUKE: something that has to be available 24/7. <br /> DEFRANCO: To the public. <br /> ROY: I could speak to a little bit about that. <br /> DEFRANCO: Okay. <br /> ROY: I did a timeline kind of going back through, and starting in 1987 was the first time the <br /> landowner requested, you know, some kind of measure of control, and throughout the years the <br /> Planning Department and the Mayor's Office in fact reiterated that, and I'll just read some <br /> excerpts. Here is a good one from September of 2000 from the Mayor's Office, "vehicles parked <br /> in the area should not be towed away nor should patrons parking in those stalls be required to <br /> pay." This is based on the condition, so, that was everybody's interpretation of the condition over <br /> and over again up until 2017. Deputy Director Darrow wrote again, again, you know, the parking <br /> stall should not be chained off, developed, and that, without coming back for an amendment. So, <br /> the County reiterated again and again over the past 30 years that the condition stands, and the only <br /> way to kind of change that would be to come back to where we are today. So, it really wasn't the <br /> fault of the landowner; it was the County kind of reiterating that stance through official <br /> correspondence that, yep, condition is unfettered free parking for the public. <br /> DEFRANCO: Thank you. And so, one more question too just so I understand: The actual parking <br /> lot, it sort of connects to a different road, right? This, isn't it sort of a connector that you can drive <br /> through and get back to Ali`i Drive <br /> ROY: Maybe we've got a map. <br /> DEFRANCO: up to Kuakini. <br /> FUKE: I think that road is called Hanama Place. <br /> DEFRANCO: Yeah, Hanama Place, right, but then <br /> VITOUSEK: And then on the back side Sarona Road. <br /> DEFRANCO: Sorry, what? <br /> ROY: Sarona Road. <br /> VITOUSEK: It connects to Sarona Road on the backside <br /> 8 <br /> EXHIBIT A <br />
