And so that would be the first procedural issue that I would <br />recommend, is that you confirm with the parties that they’ll agree to consolidate these for action; <br />and then you go ahead and take that action. After you’ve consolidated, assuming you <br />consolidate these two issues, then it becomes really up to you how you would want to handle it. <br />I would think that at some point you would want to entertain a motion that would, well, you <br />could possibly entertain a motion that would deal with everything in one motion, if it fits that <br />way. <br />ALAMEDA: Follow-up, Commissioner Siracusa? <br />SIRACUSA: Follow-up questions, yeah. I don’t see how we could do one motion if one <br />motion would be at the very least on the Change of Zone and the other would be on an SMA. It <br />would seem that at the very least we would have to do two separate motions -. <br />TORIGOE: Right. <br />SIRACUSA: To keep it from getting too convoluted. <br />TORIGOE I think you’re right. That would probably be the better way to do it. And, <br />also, think about the relationship between the Rezoning and the SMA Permit. Basically, the <br />SMA Permit ought to be consistent with whatever the rezoning is. <br />ALAMEDA: That sounds good. Commissioner Siracusa, I think you’ve got it right. <br />Commissioner Domingo? <br />DOMINGO: Just from Jeff, you know, in the event that we revoke the Change of Zone <br />Ordinance and the SMA Permit, then in the future should the owner decide to come in and <br />develop that, then they would have to go through another rezoning procedure and an application <br />for an SMA Permit? <br />DARROW: If the applicants choose to develop it as it is now, a 50-lot subdivision, if <br />the Planning Director’s initiative passes, then the property will be zoned RA-5 acres. So they <br />could do, you know, a development on 5-acre lots. But, again, it would require the development <br />to come before the Planning Commission through the subdivision of the lots for the Special <br />Management Area Use Permit. <br />DOMINGO: I just want to clarify that in my mind because I kind of heard you say once <br />it’s revoked then they would have to come in for any application, for another SMA Permit; and if <br />I heard correctly I didn’t hear you saying that they need to come in for another rezoning <br />application. <br />DARROW: Yeah, the Special Management Area Permit that they would need to come <br />in for would be for the subdivision of the 5-acre lots, cause right now the property is <br />approximately 38 acres. So they’d still need to go through the subdivision, which would trigger <br />the requirement of a Special Management Area Use Permit. Thank you. <br />EXHIBIT A <br />4 <br /> <br />
