and come back and say, well, we kind of messed that up already ‘cause the survey wasn’t <br />done or something. <br />YUEN:Well, I think that we could say that the metes and bounds survey <br />should be prepared prior to Final Subdivision Approval, because that should be included <br />in the Final Subdivision map. <br />GRAHAM:Okay. Thank you. <br />WATANABE:You’re in agreement to that? <br />LAU:Yes. <br />WATANABE:Thank you. Okay. Seeing like there’s no further discussion on this <br />matter, may I ask for a motion? Mr. Graham? <br />GRAHAM:I move that the Hawai`i County Planning Commission grant <br />Special Management Area Use Permit, SMA 05-007, including the recommendations <br />given by the County of Hawai`i Planning Department on the yellow sheet, dated 5/30. <br />And I also just want clarity on the deeding of the Quitclaim or whatever of the areas to <br />the State. And I know in our Condition 13, we have a final sentence which says that <br />“Upon request of the State, the Applicant shall quitclaim to the State any portions of the <br />Judd Trail that are within the property boundaries.” And I think perhaps Commissioner <br />Iwashita made an agreement with the Applicant here about some of the buffer area also <br />being included. And so maybe Commissioner Iwashita could just clarify for my motion <br />exactly how that No. 13 should read with regard to the quitclaim. And I’d also like to <br />include No. 13 what the Planning Director and the Applicant just agreed to that the metes <br />and bounds survey of the Judd Trail shall be prepared prior to Final Subdivision <br />Approval. Thank you. <br />IWASHITA:The buffer would be a 10-foot buffer easement for no building <br />purposes, I guess, other than for the reconstruction or restoration of the Judd Trail wall. <br />GRAHAM:Fine, thank you.
