GRAHAM:I can remember, I don’t exactly know when, but a couple of years <br />ago, and I was on the Commission then, Shawn Nakakura was sitting right up there with <br />the business partners, I think, for a Special Permit out in Kohanaiki Business Park. It <br />seems a bit unusual to myself and probably to others that the owner of the other, of the <br />operating facility here in Kailua-Kona would be so involved in your application. And <br />since you’re in contact with he as well as these folks here, can you give me any little <br />sense for why he’s so involved? <br />FINE:I’m not one of the Applicants, if that’s what you mean. I’m just <br />testifying -. <br />GRAHAM:No, I mean that you’re in contact with the Applicants here, <br />obviously ‘cause you’re sitting at the desk with them and you went out and viewed <br />Mr. Nakakura’s facility and all that. So I was thinking that you’re maybe a person who <br />sees both of the parties from a non-adversarial way; and I was just wondering if you had <br />the insight as to why Mr. Nakakura has chosen to get involved in these folks’ application <br />because that is a bit unusual in our usual practices. <br />FINE:He was in the general area and just asking people what we thought <br />of the crematorium and he approached me, I manage my own properties. I was working <br />around my building that day and one of my tenants introduced me to him and he <br />explained who he was; and I really hadn’t concerned myself too much with it. And he <br />was explaining the crematory process and, you know, some of the drawbacks. And he <br />asked me did I want to come and view a cremation. And, so, he wanted me to testify for <br />him, they wanted me to testify for them, I was indifferent. But I thought if I’m going to <br />testify for anybody I didn’t want to look stupid so I just did some investigation. I went <br />out and viewed what he was doing, and then called the American Crematory Equipment <br />and told them what I saw and talked to their technician; and the technician said, well, if <br />this happened, then he must have done this. And-. <br />GRAHAM:Yeah, I understand all this details but you’re saying he wants you <br />to testify for him. Well, he has no application here, that’s what I’m saying. So I’m <br />wondering is this just purely a competitive thing that he doesn’t want the competition, is <br />there something else -? <br />FINE:That I don’t -. <br />GRAHAM:If somebody kind of saw me on the street and says why don’t you <br />come see my thing and all, I think I’d want to know a little more about it. <br />FINE:Well, I’m assuming that he would not want the competition but we <br />didn’t get into that. And personality-wise I think Shawn’s a great guy. I met him and <br />he’s a hard worker; and he’s running a legitimate business. Somehow I got involved with <br />this and I know more about cremation than I ever wanted to know. <br />GRAHAM:Thank you. <br />EXHIBIT D <br />6 <br /> <br />
