EMLER: Work address, 75-5760 Kuakini Highway, Suite 110, Kailua-Kona, Hawai‘i. <br />HOUSEL: Thank you. We had some question raised regarding Haukapila Road. Is that a <br />private road? <br />EMLER: Haukapila Street? <br />HOUSEL: Yes, excuse me. <br />EMLER: As far as the County is concerned, it would be a private road. On the makai portion <br />where it goes across private properties, it’s an easement road over private properties. And then <br />the hospital owns the road over their property. And this particular parcel that we are discussing <br />today has a non-exclusive easement over the hospital property access. So the makai portion of it <br />is going over private properties to get to the hospital property, and from there within the hospital <br />property there is a non-exclusive easement for the subject property there. <br />HOUSEL: I see. So from the connection to Mmalahoa, it goes across private property at that <br />point? <br />EMLER: That’s correct. <br />HOUSEL: I see. And then it -. When does it -. Is any of the road on County property? <br />EMLER: No. <br />HOUSEL: No. <br />EMLER: The County used to own the hospital property, but it was conveyed to the State. <br />HOUSEL: Okay. Who maintains the street? <br />EMLER: Well, that’s a good question, because the County does not assume the maintenance <br />responsibility for it – let’s put it that way – formally. However, in the past there has been, <br />because of the controversy that has happened over the roadway, the County has taken upon itself <br />to do some maintenance on the road, but voluntarily and not because it was our legal <br />responsibility. <br />HOUSEL: I see. Does this road meet County standards? <br />EMLER: Well, the standards that, I would think, you are referring to would be, say, a current <br />Subdivision Code standard. If that is your question, the answer is no. It is an existing private <br />road with existing commercial, industrial – commercial, I guess, the hospital would be <br />considered a commercial use – being used for that purpose. As far as I know, there is no <br />subdivision being proposed for this development. So it would be up to the members of the <br />Planning Commission and the County Council to decide whether that road is adequate to serve <br />15 <br />EXHIBIT A <br /> <br />
