VITOUSEK:So removing, so basically this condition would allow the Planning <br />Department or the County to take away a mauka view, in other words, to deprive the <br />Blasman property, units on the Blasman property of a view mauka <br />order to protect a native Hawaiian customary and traditional practice? IsnÓt that correct? <br />YUEN:Yes. <br />VITOUSEK:And so that, so again the native Hawaiian customary and traditional <br />practice is placing a limitation on a ownerÓs use of a fully developed property in that <br />context, isnÓt that correct? <br />YUEN:Yes, thatÓs one of the interests thatÓs being protected. And by a condition <br />of this nature, and what are the consequences of having that is, that the view mauka will <br />be blocked. <br />VITOUSEK:And so the exercise of native Hawaiian customary and traditional rights on <br />an adjoining property is the legal basis on which the Planning Department would <br />recommend reducing the Blasman property ownersÓ ability to have a mauka view from <br />their property? Is that correct? <br />YUEN:ItÓs part of it, yes. <br />VITOUSEK:Was there another part? <br />YUEN:The general public. <br />VITOUSEK:But I think you said that the general public would not be adversely <br />impacted by being seen by people from the Blasman property. <br />YUEN:I think, no -. <br />VITOUSEK:And that was an issue that was specific in native practitioners. <br />YUEN:YouÓre trying to separate out the impacts Î. <br />VITOUSEK:Yes, I am. <br />YUEN:And present them as, as being separate. The purpose of the planting <br />screen is primarily to, so that people visiting the site donÓt see modern buildings adjacent <br />to it on the Blasman property. ThatÓs the purpose of the planting screen. And weÓve <br />gone through that over and over again. <br />One of the groups of the people entitled to some special consideration in this, one of the <br />groups of people that are having their view out, protected is native cultural practitioners. <br />26 <br /> <br />
