BRODER:My name is Sherry Broder and I am the Hearings Officer <br />appointed by the Planning Commission for the County of Hawaii. <br />GALDONES:Thank you. <br />TSUKAZAKI:Ben Tsukazaki, I am the attorney for the Applicant. <br />GALDONES:Mr. Yuen? <br />YUEN:Go ahead. <br />ARAI:My name is Daryn Arai. IÓm representing the Planning <br />Department. Sitting next to me is our Planning Director, Christopher Yuen. <br />GALDONES:Okay. Thank you very much. Mrs. Broder? <br />BRODER:Okay. I have submitted a report to the Planning Commissi <br />its Findings of Fact and Conclusions of Law and Recommendation. ItÓs 33 pages long so <br />IÓm not going to go over all the details. I wanted just draw your attention to page, <br />starting on page 28, which is the Recommendation and it includes <br />the most part, I adopted the conditions proposed by the Planning Director and I added a <br />few additions based on the testimony and the evidence that was p <br />If you go back to page 4, it describes what the Applicant was willing to agree to itself. <br />So the Applicant, which is Doutor Coffee, in its application indicated that it would follow <br />these guidelines. So all of these guidelines are incorporated into the limitations on the <br />permit. These include assigned days and time, a period of time <br />the tours, the business hours, 9 a.m. to 4 p.m. The Applicant indicated that they would <br />agree to a certain decibel level for the noises. They wanted to include, in No. 3 they said <br />the guest arrivals will be no more than 80 per day. Item ÐdÑ wa <br />retail non-agricultural items within two existing gazebos, not to exceed a gross floor area <br />of 1,000 square feet, although with the possibility of future expansion. They said that <br />they would turn on their water fountain feature which is actually quite a large feature, itÓs <br />a big, big reflecting pool, only during business hours, and only when guests and visitors <br />were present. They do serve food on the premises; they indicated that they would abide <br />by family-style picnics, except on Sundays. They said that they would have special <br />events directly associated with products grown on the subject property. <br />Other types of functions such as weddings, farmerÓs market, craf <br />permitted. They said large tour buses will be discouraged from <br />property. I thought that, we did a site visit and I thought it was quite evident that thereÓs <br />a traffic problem on Mamalahoa Highway, that the large buses were a problem for the <br />residents and that -. We followed the route that the large tour buses would take in terms <br />of dropping visitors off on an unimproved site at the present time where rocks were <br />moved, back-and-forth, depending on whether or not the tour buses are there, and then go <br />3 <br /> <br />
