MOOERS:That was one of the options we looked at. Initially, this property <br />was owned by the same individual who did Kona Hills, Phase 1 and <br />was the intent, was to keep the one-acre size to be consistent with those dwellings. Also <br />because of the grade in the area, once you start getting much smaller than one acre, then <br />you start getting into a lot of engineering turfs in building walls and that sort of thing, and <br />it loses its effectiveness, the cost effectiveness. So thatÓs why we would like just to stay <br />at this level. <br />SPRINGER:Thank you. <br />MOOERS:And one other thing is that the availability of water also is a <br />determining factor. Commissioners, before we go into decision-making, considering the testimonies <br />that have been presented to the Commissioners and the concerns that they have raised, I <br />would like to have our Counsel, Mr. Torigoe, give us or inform us what the options are in <br />dealing with this subject matter. <br />TORIGOE:Thank you, Mr. Chairman. I refer you to your Planning <br />Commission Rule 11-3(b), in Subsection 2, which says, ÐWithin ninety (90) days after <br />receipt of the application from the Director, unless a longer period is agreed to by the <br />applicant, the Commission shall transmit the proposed change of zone ordinance together <br />with its recommendations thereon through the Mayor to the Council. The Commission <br />shall recommend approval in whole or in part, with or without modifications, or rejection <br />of such application. In the event that the Commission fails to act on the application <br />within the ninety-day period, the application shall be considered an unfavorable <br />recommendation by the Commission, and the application shall be transmitted through the <br />Mayor to the Council with such recommendation.Ñ <br />GALDONES:Mr. Torigoe, does that also give the Commissioners the option to <br />have a continuance on this subject matter pending more informati <br />34 <br /> <br />
