I dont see, often times <br />theres that landscaping condition and I dont see that here. <br />YUEN:We- there is a landscaping, it simply says landscaping in accordance <br />with rule 17, which is the overall landscaping rule. <br />SPRINGER:What? Oh I see and thats in condition number 4? Thank you and this <br />mauka-makai access that Mr. Tyler has brought to our attention, do you have any comments <br />on that? <br />YUEN:I dont know anything about it, is that part of the conditions? <br />DARROW:Uh, this is an identified sewer easement that Mr. Tyler is referring to <br />andapparentlyAliiCovehadusedthatsameeasementasamauka-makaiifImnotmistaken. <br />YUEN:Wecouldputthatinasaconditioniftheapplicantdoesntmind.We <br />didnt really look at this as- we didnt look at public access in connection with this property <br />being that its not shoreline at all. And so, but its a good idea, its a nice idea for people to be <br />able to walk down from Kuakini. Is it formally a condition of Alii Cove that they have the <br />sewer line easement through there as a public access? Do you know? <br />TYLER:Is that directed to me or? <br />YUEN:Is it required of Alii Cove or is just something that theyre doing? <br />TYLER:I cant tell you whether its a condition of their rezoning or not. I know <br />that Mr. Deweese agreed to this. We had discussion with it- about it a the Council as well as <br />at the committee level and I know that Mr. Emler spoke to me about it this morning saying <br />that he had some questions and wanted me to know. He wanted to know what the intent was. <br />YUEN:Yes. <br />TYLER:So, as I began my comments today I said that I thought it would be <br />better or to answer one of the questions, to commit these things to writing so that the <br />appropriate agencies have a clear understanding. And I want to make it clear that I dont see <br />this as a 24-7. Again make it clear. Because it will be some responsibility falling on the <br />landowner and I dont want it to be, to have security there all night long. <br />GALDONES:Commissioner Springer? <br />SPRINGER:Mr. Chair Im wondering if this-, were not going to be making a <br />decision on this application and the conditions of it at this time so is this something that might <br />be researched for our next hearing of the matter. <br />EXHIBIT C <br />18 <br /> <br />
