HOUSEL: Maija, are you going to present? Oh, you are not going to present? Okay. <br />COTTLE: Mr. Chairman, if the Commission would like me to do a presentation, I did one at the <br />last hearing, but we can refresh and -. <br />HOUSEL: Would any of the Commissioners like another presentation? Okay, I guess no. <br />Thank you. <br />COTTLE: Okay. <br />HOUSEL: Okay, I guess if you can give us a short overview -. Would that be possible? <br />COTTLE: Yes. <br />OLSON: Mr. Chairperson, Peter Olson for the Crumrine Family Trust. If Ms. Maija is going to <br />do a presentation, she is a party to this matter and I have a right to cross-examine her before we <br />start on this matter. <br />HOUSEL: No, she is not a party. <br />OLSON: Okay, well, we object to this. <br />HOUSEL: I’m going to have to overrule that objection, sorry.Maija? <br />COTTLE: The subject application is an SMA use permit. This is a Special Management Area <br />use permit, and the applicant is Dr. William Foulk. The subject property is located in the North <br />Kona District about three miles south of Kailua-Kona, and it’s located along Hlualoa Bay just <br />on the north edge of the bay. You can see the subject property outlined in black on the slide in <br />this location. Ali‘i Drive is located on the eastern boundary of the property and runs in a north- <br />south direction through the middle of the slide here. And then the property is also located along <br />the shoreline that makes up the western boundary of the property. <br />This map shows the current zoning of the property, as well as the surrounding properties. You <br />can see the purple areas are zoned Resort-Hotel and the green areas are zoned Open. The areas <br />zoned Multi-Family Residential are shown in brown. And this is a close-up view of the <br />property; again, you can see the subject property outlined in black, the two properties to the north <br />and south are zoned Resort-Hotel, and then beyond that the properties are zoned Open along the <br />shoreline. This is the Kona Community Development Plan map, and the subject property is <br />located right about in this general area where the dot is shown; it’s not located in a Transient <br />Oriented Development designated area, but it is located within the Kona Urban area. <br />This is an aerial photo of the property. You can see the two existing dwellings; this is the main <br />dwelling in the middle of the slide and a second dwelling just north of that. You can also see the <br />triangle-shape pool out on the lava near the shoreline, and Ali‘i Drive running, again, in a north- <br />2 <br />EXHIBIT C <br /> <br />
