property is approximately 3.0 acres in size and situated within the County's Agricultural- <br /> 3 acre (A-3a) zoned district. The applicant currently resides in the existing single-family <br /> dwelling on the subject property and the proposed four-bedroom bed and breakfast will <br /> operate within the existing dwelling's footprint. As previously noted, the applicant will <br /> maintain agricultural uses on the property, including existing fruit tree and vegetable <br /> garden cultivation. Given the above, the proposed bed and breakfast will not diminish the <br /> potential for any future agricultural activity on the subject property. <br /> Based on the preceding,the subject request is considered an unusual and reasonable <br /> use of the agricultural land. <br /> In addition to the above listed criteria,the Planning Commission shall also consider <br /> the criteria listed under Section 6-3(b)(5) (A) through (G). In considering the criteria, the <br /> Planning Director recommends the following: <br /> (A) Such use shall not be contrary to the objectives sought to be <br /> accomplished by the Land Use Law and Regulations. The subject request is considered <br /> an unusual and reasonable use of the agricultural land and the proposed use will not <br /> adversely affect the preservation and agricultural use of the County's prime agricultural <br /> lands. <br /> (B) The desired use shall not adversely affect the surrounding properties. <br /> Surrounding properties are zoned Agricultural 3-acre (A-3a) and consist primarily of <br /> agricultural and residential uses and undeveloped land. Bed and breakfast operations are <br /> by definition accessory to a single-family dwelling use and given that the applicant will be <br /> the operator, there should be no more impact than that of the existing dwelling. According <br /> to the applicant, the existing dwelling was sited to maintain a one-acre buffer of dense <br /> vegetation between the subject property and the adjacent neighbor to the rear of the <br /> property. The applicant has been operating a hosted vacation rental for several years and <br /> while the Planning Department has a record of a complaint from a member of the public, <br /> the case was successfully closed as there was no substantiated code violation occurring on <br /> the subject property. At the time of this writing the Department has received six letters of <br /> support from surrounding and adjacent neighbors of the subject property and has received <br /> -3- <br />
