The proposed use is an unusual and reasonable use of land situated within the
State Land Use Agricultural District and would promote the effectiveness and
objectives of the State Land Use Law and Regulations and Chapter 205, HRS, as
amended. The State Land Use Law and Regulations are intended to preserve, protect, and
encourage the development of lands for those uses to which they are best suited in the
interest of the public welfare of the people of the State of Hawaii. In the case of the
Agricultural District, the intent is to preserve or keep lands of high agricultural potential in
agricultural use.
The proposed development of a bed and breakfast establishment on the existing
residential property is unusual since it is not agricultural-related. However, the proposed
use will occur within an existing dwelling and will not prevent the remainder of the
property from being used for agricultural purposes. Further, the property does not have a
high potential for agriculture and may better provide for the landowner through its use as
a bed and breakfast. It is therefore determined that the proposed use is an unusual and
reasonable use within the Agricultural District and will not be contrary to the objectives of
205A, HRS, as amended.
In addition to the above listed criteria, the Planning Commission shall also consider
the criteria listed under Section 6-3(b)(5) (A)through (G).
(A) Such use would not be contrary to the objectives sought to be
accomplished by the Land Use Law and Regulations. The subject request is considered
an unusual and reasonable use of the agricultural land and the proposed use will not
adversely affect the preservation and agricultural use of the County's prime agricultural
lands.
(B) The desired use shall not adversely affect the surrounding properties.
The properties immediately to the north, south, and west of the subject property are
similarly zoned Agricultural-1 acre (A-la) and used for residential purposes. The property
to the east is zoned Agricultural-5 acres (A-5a) and is mostly undeveloped. The operation
of a bed and breakfast is considered an accessory to a single-family dwelling use, and as
such, should not have any greater impact than the existing dwelling. The applicant intends
to maintain the plant life on their agricultural site, which includes monstera, heliconia, bird
2
