1. The applicant, their successor(s), or assign(s) ("Applicant") shall be responsible <br /> for complying with all stated conditions of approval. <br /> 2. The development and operation of the proposed use shall be conducted in a <br /> manner that is substantially representative of plans and details contained within <br /> the Special Permit Application, any subsequent material received by the Planning <br /> Department, and any representations made to the Leeward Planning Commission. <br /> Any substantial expansion or uses beyond what is represented shall require an <br /> amendment to this permit. <br /> 3. As represented by the Applicant, pre-school enrollment shall be limited to 100 <br /> students,the alternative education program shall be limited to 43 participants at any <br /> one time. <br /> 4. Prior to submitting plans for a building permit,the Applicant shall secure Final Plan <br /> Approval for the proposed development from the Planning Director in accordance <br /> with Section 25-2-70, Chapter 25 (Zoning Code), Hawaii County Code. Plans <br /> shall identify all existing and/or proposed structure(s), fire protection measures, <br /> paved driveway access and parking stalls, outdoor lighting (if any), and other <br /> improvements associated with the proposed development. <br /> 5. The Applicant shall limit water usage to Department of Water Supply allocations. <br /> Prior to issuance of a Certificate of Occupancy, the Applicant shall construct <br /> necessary water system improvements as may be required by the Department of <br /> Water Supply. <br /> 6. Prior to issuance of a Certificate of Occupancy, the Applicant shall implement any <br /> improvements required by the Fire Department and/or Department of Water Supply <br /> to ensure that fire protection requirements can be met for the proposed use. <br /> 7. Prior to issuance of a Certificate of Occupancy, an individual wastewater system(s) <br /> shall be installed, and permitted for the proposed use, meeting with the standards <br /> and requirements of the State Department of Health. <br /> 8. Access to the project site from Mamalahoa Highway, including proposed access <br /> modifications and mitigation measures described in the Special Permit <br /> -12- <br />
