NEW BUSINESS <br /> 1. APPLICANT: RIAAN MATTHEUS (PL-SPP-2023-000041) <br /> Application for a Special Permit to operate a 4-bedroom bed and breakfast establishment <br /> within an existing dwelling on approximately 3.0 acres of land in the State Land Use <br /> Agricultural District. The subject property is located at 16-1456 Moho Road, <br /> approximately 2.6 miles southeast(makai) of its intersection with Highway 11, Hawaiian <br /> Acres, Kea`au, Puna, Hawaii, TMK: (3) 1-6-050:058. <br /> At 9:05 a.m. Chair Lin recused himself from this item due to a conflict of interest as he assisted <br /> the applicant, Riaan Mattheus, in personal matters in the past. Pursuant to Planning Commission <br /> Rules 14(d), Vice Chairperson Louis Daniele assumed the duties of the chairperson. <br /> [TIMESTAMP 5:31] <br /> The Commission took up this item at 9:05 a.m., with three public members in the audience. <br /> [TIMESTAMP 6:16]. <br /> There were no in-person or Zoom testifiers for this agenda item. <br /> Staff presentation by Christian Kay [TIMESTAMP 7:29]. <br /> Applicant presentation by Riaan Mattheus, Applicant[TIMESTAMP 13:00]. <br /> It was moved by Commissioner Perrin and seconded by Commissioner Balog that the application <br /> for Special Permit No. 2023-000041 be approved based on the Planning Director's <br /> recommendation. [TIMESTAMP 17:06]. A roll call vote was taken, and the motion carried with <br /> four ayes (Perrin, Balog, Cross, and Daniele), no noes, one recused (Lin) and one absent and <br /> excused (De Luz). <br /> This hearing ended at 9:17 a.m. <br /> At 9:18 a.m. Chair Lin resumed his role as presiding officer. <br /> PLANNING DIRECTOR'S REPORT [TIMESTAMP 18:53]. <br /> Report on Special Management Area (SMA) determinations, minor permits action issued <br /> by the Planning Director. <br /> At 9:18 a.m. Chairman Lin introduced this item and stated the Short-Form Assessment Log and <br /> the SMA Assessment Log were emailed to the Commissioners. There were no questions about <br /> the log from Commissioners. <br /> Report on Act 229,which amended State law relating to the Special Management Area. <br /> At 9:18 a.m. Chairman Lin introduced this item and stated the material was emailed to the <br /> Commissioners. Planning Program Manager, Maija Jackson stated Act 229 was recently adopted <br /> and signed by the Governor.
