SPRINGER:Commissioners, any further discussion or comments on this <br />matter? I would just voice that at the previous hearing of an application by RTs Towing <br />Service, I voted against it for my concerns with regard to this sort of activity in the <br />agriculturally-zoned land and due to the issues brought forward by the residents of the <br />area. But in my quick perusal of this, I see what seems to be a good faith effort on the <br />part of the Applicant to seek another location. And having gone through the Contested <br />Case Hearing previously, I understand the amount of effort and some of the constraints <br />on the Applicant to find the appropriately-zoned and subdivided property. So Ill be <br />voting in favor of it, with reservations, at this hearing. Are there any additional questions <br />or comments? <br />May I have a motion then on this matter before us now, which is the Applicant RTs <br />Service coming forward for a Special Permit to allow office and storage uses for <br />investigative/collection services, towing service, and short-term parking for repossessed <br />ordisabledvehiclesonapproximately14,273squarefeetoflandwithintheStateLand <br />Use Agricultural District. Well be making our decision based upon the Planning <br />Directors Background Report and Recommendation to us and our discussion at this time, <br />which includes -. Jeff, if you could go over for us, please, the amendments to the various <br />conditions? <br />DARROW:Yes, Madam Chair, thank you. <br />Condition 2, we will be adding a sentence that will state, Should industrial-zoned lands <br />become available, the Applicant shall have one year to relocate to the industrial zone. <br />Condition 7, which has been added by Commissioner Siracusa which, in essence, will be <br />asking that the Applicant continue to make a good faith effort, to make every effort to <br />relocate to a properly-permitted zoned district. <br />Condition 7 will be a new condition. All conditions after 7 will be renumbered <br />subsequently. <br />SPRINGER:Thank you, Mr. Darrow. Members, are there any questions or <br />comments? May I have a motion? <br />ALAMEDA:Madam Chair? <br />SPRINGER:Commissioner Alameda. <br />ALAMEDA:Id like to move that Special Permit application (SP 04-013), that a <br />favorable recommendation be forwarded to the County Council, and that the <br />recommendation by the Planning Director which states that the request to allow office <br />and storage uses for investigative/collection services, towing service, and short-term <br />parking for repossessed or disabled vehicles on approximately 14,273 square feet of land <br />be approved by the Planning Commission with the condition to not exceed a period of <br />five years from the date of issuance of the Special Permit.
