SIRACUSA:I was just going to say so we can approve this contingent upon <br />approval from the Department of Health? <br />MOOERS:Yeah, thats whatthe condition says, Condition 4. <br />GRAHAM:And my real concernabout the SMA and the ocean resources is, <br />you know, nutrients entering the ground water; and my understanding is that the <br />Department of Health is not dealing with that issue. The Department of Health is dealing <br />with the issues is it safe forpeople to be in the ocean off of this. Its not, the Department <br />of Health is not dealing with whats the impact on algae blooms or anything else like that. <br />So thats what leaves me concerned about these individual treatment systems there, just <br />in the way, you know, from Puako people have always been concerned about the <br />cesspools which are even less efficient than a septic system. So I dont know where Im <br />goingwithitbutImconcernedaboutproliferationofsepticsystemssoneartheoceanat <br />such a special point as this. <br />SPRINGER:Commissioner Graham, could we perhaps ask the Director to make <br />comments on your question and how he might have analyzed the situation before <br />bringing the recommendation to us? <br />GRAHAM:Please. Thank you. <br />YUEN:I think what youre saying about nutrient levels is correct insofar <br />as the Department of Health regulations in where they allow septic versus cesspools <br />versus sewer. Septic versus cesspools is a health issue rather than a nutrient issue. I <br />would not look at nutrients as being very significant in a question of an SMA Permit <br />going from a one unit to a three-unit approval, especially well away from the shoreline <br />where youre going to have a septic system and not a cesspool anyway. <br />SPRINGER:Mr. Graham, any follow-up? <br />DARROW:If I could -. <br />SPRINGER:Commissioner Siracusa? Im sorry, Mr. Darrow. <br />DARROW:I was just going to mention to Commissioner Graham that the area <br />he was referring to is in the Background Report on page 3, No. 22, and that was <br />referencing the information from the Department of Health and also regarding the <br />variance. But, again, weve tried to address that in the condition that they need to install <br />an approved septic system meeting with the Department of Health. So if their approval is <br />only for two units then, at that point, if there is a variance process, then maybe they can <br />apply through that. <br />SPRINGER:Thank you both.
