setback. The Planning Department determined that the infilling of the swimming pool didnot <br />need a variance and the applicant had met with the Planning Director and came to an agreement <br />that they would eliminate the makai most seating row and therefore have 1 seating row that <br />would extend into the shoreline setback 8 feet 10 inches. The area identified in blue is an <br />existing rock wall that is, was determined on January 24, 2005 by the Chairman of the Board of <br />Land and Natural Resources to be the certified shoreline so that would be at the base of the <br />makai side of this wall. The applicant is also proposing in this particular area to fix a ADA <br />accessible ramp in this particular area to allow the public to be able to come from the south lawn <br />grass area as well as the public access area and to be able to come into this area to the north of <br />the Kona Inn Shopping Village. The Planning Department has not received any letters of <br />opposition or support for this particular application. The Planning Director is recommending <br />that this request be approved by the Planning Commission. I do have a few minor changes that <br />Id like to bring to your attention. We apologize for the several revised background and <br />recommendations. The second revised background and recommendation will be the final <br />backgroundandrec.Wedliketoincorporatethefirstrevisedintothesecondsowedbeadding <br />the underlying portion that is in the first revised under subsection 1-B and we will incorporate <br />that into subsection 1-B in the second revised. Additionally on page 2 of the background, in item <br />2E bullet number 1 on the last line wed like to change 20 feet to 8 feet 10 inches and <br />additionally the same change made on the third bullet on the third line, 20 feet to 8 feet 10 <br />inches. Apologize for that error. Are there any questions? <br />GALDONES:Commissioners any questions of Jeff? Commissioner Graham? <br />GRAHAM:Jeff is the ADA ramp physically contiguous in any way with the seating <br />area thats being requested? <br />DARROW:Thank you for bringing that to my attention. Im going to pass out some <br />photos here. Were going to be looking to photo number 3 and number 1. You can see it in a <br />photo number 1 will display the area where the lanai will be placed and to the right along the <br />wall will be the area where this ADA ramp will be placed. As far as it being, is your question <br />that it, is it connected to the seating lanai? It appears to be separate from it. But it will enhance <br />the public access for this area. <br />GRAHAM:Thank you. <br />GALDONES:Any further questions of Jeff? Seeing none is the representative or the <br />applicant here?
