GALDONES:Thank you. Mr. Torigoe? <br />TORIGOE:Thank you, Mr. Chairman. Having heard the objection, I think we <br />do need to proceed with a little bit of caution since there was a formal objection raised <br />with respect to Mr. Loves participation. Now he is basically commissioned to provide <br />the Commission with a report and proposed findings, which he has done. And I think, as <br />Ms. Song had stated, the rules seem to indicate that the parties should have an <br />opportunity to respond to the report. And I do feel a little bit uncomfortable with, you <br />know, with just kind of opening the floor to allow Mr. Love to make further comments, <br />and that may be in rebuttal or that may tend to support some of his conclusions. So, you <br />know, I feel a little uncomfortable with just opening the floor for Mr. Love to further <br />comment on his proposed findings and report. <br />So Im not sure exactly what, at this point, were asking Mr. Love to do. I suppose if he <br />justwantstopresentthedocumenttoyouandseeifyouhaveanyparticularquestions <br />about that authenticity of it, thats not a problem. But I would feel a little concerned <br />about going, you know, allowing him to make excessive commentary on the substance. <br />GALDONES:Thank you, Mr. Torigoe. Commissioners and counsel present <br />here, this is my instructions to the Commissioners as to the procedure, how we will be <br />proceeding on this matter, and Ill open it up for discussion so we all can be on the same <br />page how we will be proceeding. <br />The Commissioners have received three sets of Conclusions of, Findings of Facts, <br />Conclusions of Law, and Hearing Officers Recommendation. We have received <br />Mr. Colins; we have received, representing the Department, Ms. Leithead-Todds; and, <br />also, we have received from the Applicants, Ms. Songs. So those are the three sets of <br />Findings of Fact, Conclusions of Law, and Hearing Officers Recommendation. These <br />have been submitted to the Commissioners for your review and, today, we will be making <br />a decision on those. <br />In terms of procedure, we will be, I will be entertaining to accept Mr. Loves Findings of <br />Facts, Conclusions of Law and Hearing Officers Recommendations; and if the <br />Commissioners have any questions for clarification purposes, now, we will be directing it <br />to the maker, which is Mr. Love. <br />Then we also will be giving the same opportunity to, for you to question the Findings of <br />Facts, Conclusions of Law and Hearings Officer recommendation from Ms. Leithead- <br />Todd and, also, from Ms. Song. This is for the purposes of clarification and not for <br />further rebuttal. That is how we will be proceeding. However, theres a little twist in this <br />because of what Norman had mentioned, is that the, was that, the 15-day period in which <br />they have a chance for rebuttal. <br />HAYASHI:Yes. The deadline to file exception was today from the, that was <br />15 days from the date that the Hearing Officer filed his report with the department or to <br />the Planning Commission. <br />5 <br /> <br />
