ALAMEDA: Commissioner Domingo? <br />DOMINGO: Well, you know, I kind of -. <br />ALAMEDA: Do you have a question for her? Could I let our testifier go or do <br />you still have questions? <br />DOMINGO: Well, just in response to what she said, you know, I kind of <br />question about the ability of the Planning Department being able to enforce these rules. <br />You know, they’ve been diligent in trying to do what they can; and it brings me back to a <br />situation where a special permit was issued and there are constantly being infractions <br />with regards to performance of the conditions. You know, they were asked to pay a fine <br />every day; and as I calculated it probably would have amounted up to $40,000 of fine for <br />infraction of one item on that special permit. So, you know, as far as the Planning <br />Department being able to do it, there are ways in which it can be done and it is done. So, <br />you know, I don’t question their ability to enforce the conditions that we imposed <br />through any kind of a land use matter. <br />MCCRARY: And I certainly didn’t mean to say that they had not being doing <br />their job because I think Mr. Usagawa was very, very responsive to me. You know, we <br />try not to be, we have tried to be, complain when the complaints were appropriate and <br />photographed when it was appropriate, and tried not to get to the point that nobody would <br />listen to us, you know. <br />ALAMEDA: Ms. McCrary, I was just informed by our staff that we do have to <br />keep those pictures. <br />MCCRARY: Okay, that’s fine. <br />ALAMEDA: Is that okay? <br />MCCRARY: Yeah, that’s fine. <br />ALAMEDA: All right. Thanks. <br />MCCRARY: Now will they be at the County Council? <br />ALAMEDA: Mr. Darrow, what happens with the pictures? <br />MCCRARY: Those pictures cost me fifty bucks. <br />ALAMEDA: That’s a lot of pictures. <br />DARROW: They will be with the file which I believe is transferred. <br /> EXHIBIT A <br />17 <br /> <br />
