consider it and got back to him and did in fact sell it to him in 2003. Adeed was signed for the <br />property in March of 2003. Mr. Ibbetson communicated with the State Historic Preservation <br />Division. First he contacted an individual from the Hawaii Burial Council because he realized <br />there were graves on the site. They directed him to the State Historic Preservation Division. He <br />spoke to Keola Lindsey who came out to his property along with another woman from the State <br />Historic Preservation Division, Maryanne McGrath. They told him what he was doing was <br />acceptable in terms of where he was going to put his house. He acknowledged the existence of <br />the graves, which were there at the time he purchased the property. He said he would agree to <br />allow any descendants of the deceased to visit the graves to allow access to those graves, to <br />maintain them and visit them. And, actually had his second visit from the State Historic <br />Preservation Division several months later to see how he was doing with the construction. They <br />signed off on it, they approved it, which is why at the, with the application today for a bed and <br />breakfast they said that there was no, nothing that they. They had no opposition to the <br />application because they had already been out there at the time that he was doing his construction <br />andpriortothetimethathewasdoinghisconstructiontoviewthesiteandhadacknowledgedit <br />at that time. Mr. Ibbetson built his home. He did what he said he was going to do in terms of the <br />building permits. He didnt try to hide what he was doing from anybody. Matter of fact the <br />State Historic Preservation Division commended him and thanked him for contacting them <br />because they said a lot of people dont contact them before hand. He went ahead, proceeded, <br />built his home and subsequently came to the County asking them to approve the bed and <br />breakfast, which was at that point in time that Mr. Kaiawe came to him and objected to that <br />particular use. We dont believe that Mr. Ibbetson has done anything improper in what he has <br />done out there in the construction that he has done and the method hes used to build the <br />property. He has a home there. Hes the only one living in that home at the present time. If a <br />family were living there he could have any number of individuals living there as a family. To <br />ask this commission to allow him to open it up to 4 other individuals as a part of the bed and <br />breakfast we dont believe is going to have any noticeable impact upon any surrounding <br />properties or upon the gravesites themselves.
