GALDONES:Does anyone from Counsel have any problems with that, Norman making <br />the presentation? <br />VITOUSEK:The applicant has no objection. <br />WOODELL:The intervenor has no objection. <br />GALDONES:Seeing that there is no objection Norman proceed. <br />HAYASHI:Thank you Mr. Chairman. Just as a matter of brief orientation regarding <br />the subject matter. The property is indicated by this red dot, it is situated within the Waimea <br />Village area. This is the roadway that leads into Waimea. This would be in the Hamakua <br />direction and this would be towards the Kona direction. This would be the old mauka <br />Mamalahoa Highway. This would be the Kawaihae Road leading towards Kawaihae. The <br />colorsonthemapindicatethevariouszoningdistrict.ThesepurpleshadedareasareVillage <br />Commercial zoned district. We have single family residential zoning here in yellow and we also <br />have areas that are designated agricultural 1 acre and these are the green shaded areas. The <br />applicant intends to construct a elementary school, grades K through 5 with an estimate of 45 <br />students. Access would be from Kapiolani Road and if I go back to this overall site, location <br />map, this would be Kapiolani Road and this would be Lindsey Road. So access basically would <br />be from Lindsey Road and this would hook upto Kapiolani Road. This is Puuki Road, this is a <br />dead-end road that comes off of Kapiolani Street. So access, the driveway access to this subject <br />property would be from Kapiolani Road. The hearing, the contested case hearing was held by <br />your Hearing Officer Sherry Broder and this was held on September, excuse me, July 11, 2005. <br />Since that time Ms. Broder did submit her report to the Planning Commission and that report was <br />received on September 22, 2005. Since that time we also received the intervernors exception to <br />the Hearing Officers report as well as the request for oral argument at the hearing. That <br />exception was received on October 5, 2005. The Planning Director also responded to the, <br />provided response to the intervenors exception and support of the Hearing Officers report. And <br />that was received or dated on October 12, 2005. The applicants response to intervenor's <br />exception to Hearing Officers report was received on October 12, 2005. And we recently <br />th <br />received on November 16 <br />, the applicants motion to dismiss Allen Woodell as intervenors <br />counsel. We also had several letters that were submitted including those that were circulated this <br />morning. I dont have a complete list of those correspondences but Im sure that all of you were <br />provided a copy of.
