ALAMEDA:Every applicant right now theres going to be time crunch. So we have a <br />time problem for every application before us. So Im trying to, my role is to make sure that we <br />proceed in a judicially and expeditious manner. So -. <br />EGER:Im willing to be perfectly cooperative with that goal. Ive been a <br />commissioners or board member here. But I brought a picture since youve taken one from him. <br />This shows that corner where you cant see around. It shows the, from Kaloli -. <br />ALAMEDA:Mr. Eger -. <br />EGER:Since weve got one coming in, heres another one. <br />ALAMEDA:Let me backtrack a little bit. I dont want to go too ahead of ourselves. In <br />regardtotherequestthatyoubroughtforwardaboutMs.Leithead-Todd,Iwantedtoask,again, <br />Mr. Torigoe, how should we proceed with that? <br />TORIGOE:Well, I think you need to deal with it in some fashion. I think you can <br />probably do it, you can attempt to do it fairly quickly at this point since Mr. Eger is going <br />through his exceptions and this comes up as one of the exceptions. Mr. Eger could take a break <br />from his oral argument and allow the parties to state their positions regarding the request for <br />recusal or disqualifications; and then, Mr. Chairman, you make a decision on that. Okay. <br />EGER:I would happily agree to that. <br />ALAMEDA:Mr. Eger, can we look at that issue at this time? <br />EGER:Yes. <br />ALAMEDA:Could I ask the parties your thoughts on that? Could I ask the applicant <br />first and then the Department? <br />MR. VURICH:Stating the, Im sorry, stating the use -. <br />ALAMEDA:The recusal of Ms. Leithead-Todd. <br />MR. VURICH:Oh, I dont think thats fair. I think she was very, she stated as best as I <br />can tell the situation and I dont think thats fair for -. <br />ALAMEDA:Thank you. The Department or -? <br />EGER:Mr. Chairman, I misspoke, its in 5 and 7, but the request for recusal is in <br />7. <br />ALAMEDA:Okay, so noted. <br />TORIGOE:Actually Mr. Eger should be given a chance to state the reasons why -. <br />17EXHIBIT B <br /> <br />
