SIRACUSA:Is there a logistic there, Mr. Director? <br />YUEN:We can make, require improvements to private roads as a condition of <br />approving a change of zone on those roads. So we would have the power to do that. I went on <br />Kulana Kea when we had that other rezoning application, the Plant Mason application. The <br />Kulana Kea itself is certainly an adequate road for rezoning this property from Ag-20 to Ag-5. <br />SIRACUSA:So you dont see any need to add extra wording into the conditions? <br />YUEN:No. And then the intersection at the bottom is supposed to be fixed in <br />connection with any subdivision of the 15,000 square foot zoned area across the street. So my <br />recommendation is just leave it at that. <br />ALAMEDA:Allright-. <br />CARDOZA:See,myquestioniswehad,orthePlanningDepartmenthadtorealignthat <br />road or improve it. Where is that picture went? Right? We bought that subdivision, the existing <br />lot owners, with the conditions that were there. In the event they would do the subdivision the <br />road and the water would have to coincide. Were losing something here. For the record, were <br />losing something here. Whats wrong? I dont know, I dont have the answer. If I knew I <br />would tell you. But there was a plan drawn out as far as I know. Idont have it with me. I wish <br />I would. I would share it with you. But there is something as far as I can recall. So something, <br />something is missing; and its not being brought forward. I dont know the answer. I just want <br />you folks all to know that we bought the lots the way it was, the water system and the road. The <br />improvements that was going to take place a few years ago was to coincide with water and road. <br />Evidently, something is wrong. Thats all I have to say. <br />ALAMEDA:Thank you, Mr. Cardoza. Any questions, final questions for Mr. Cardoza? <br />Commissioner Springer. <br />SPRINGER:Mr. Cardoza, with whom did this discussion take place and by whom was <br />this commitment made? <br />CARDOZA:Well, it wasnt a discussion. It was when Brewer wanted to subdivide that <br />14 acres, I believe, and make all those lots. To do that, they needed to do the water system and <br />the road. And I believe, but like I say I dont have any paperwork or maps to show you, but I <br />believe it was made. <br />SPRINGER:And the 14 acres, are those towards Hawaii Belt Road or above? <br />CARDOZA:I beg your pardon? <br />SPRINGER:The 14 acres, is that below the subject site or above? <br />CARDOZA:No. Its actually directly across the street from Mr. Olsons lot. Its 14 <br />acres. That was the Plant Mason that was bought, I think, two years ago maybe. <br />12EXHIBIT D <br /> <br />
