And so it’s a little different than just your normal <br />student. <br />CHU: The other thing is, Mr. Iwashita, there are a lot of families that come to <br />Hawaii on vacation for over 30 days at a time and they’re nonresidents. And then the children <br />that attend the school are nonresidents, and they’re not subject to the DOE laws. <br />WOODWARD: All right, thank you. Mr. McKinney, were you going to give testimony <br />or -? <br />M. MCKINNEY: No. <br />WOODWARD: No. Okay, any further questions? <br />IWASHITA: Yes. <br />WOODWARD: Commissioner Iwashita. <br />IWASHITA: I have a follow-up. It’s still my impression from the testimony that there <br />are Hawaii children attending your facility. Is that correct? <br />M. MCKINNEY: We do not have any Hawaii children attending our facility at this time. <br />IWASHITA: Okay. So that was -? <br />M. MCKINNEY: I believe I said in the past we’ve had a couple of Hawaii students, in the <br />past. <br />IWASHITA: Okay. So, well, this is problematic for me in this sense – you’ve had it in <br />the past, I’m not sure if you’re going to have them in the future.If we’re going to consider this <br />at all, it seems to me that if there is going to be a Hawaii child in your facility that you need to <br />have some provision to comply with Hawaii law. And right now it’s my impression you don’t <br />understand what the law requires. <br />CHU: If you want to put a -. Are you suggesting we put a condition that we <br />don’t admit Hawaii students? <br />IWASHITA: No, I didn’t want to do that. I’m just saying that if, you know, we can’t <br />plan for all the, some kind -. You know, if what you’re doing is, and I’m not making a judgment <br />now, but if what you’re doing is good for the kids, and apparently a lot of people think so cause <br />you have lots of children attending in your facility and it might work for some kid in Kohala to <br />go all the way to Kau cause that’s -, may as well be on the mainland, worked for Kamehameha. <br />Worked for Kamehameha, right? I mean, you know, you follow me – that there ought to be that <br />opportunity but, you know, I’m concerned that based on what you’ve said you don’t have an <br />understanding of what Hawaii law would require in order for that to be legal. <br />5 <br /> EXHIBIT B <br /> <br />
