You know, he felt that he’s entitled to go along and do <br />what he’s doing because he was there first and the zoning permits him to do it under Agriculture. <br />I told him, you know, what you’re doing is appropriate with the zoning, you have no need to <br />worry. So, in essence, what actually happened was those who were really, who were concerned <br />about that and who could not live with that environment had to move away; and he had this in <br />several areas in his community. And that proves that no matter what, you know, if you’re in <br />Agricultural land and whatever you’re doing is in keeping with that designation then by law you <br />cannot be stopped from doing it. And that’s the satisfaction I would get knowing that the law is <br />there and would protect anyone who wished to farm. <br />WATANABE: Okay, fine. Ms. Bowman, you had some comments? <br />BOWMAN: Well, first of all, it’s Low Density, not Medium Density, just so you <br />know. And I think if our rationale, what I hear some of the rationale, is well it’s in fill, it’s not <br />really good Ag land so the best use would be, you know, RA-.5, I caution us in thinking that. <br />Because I live in Kohala, I live by South Kohala and, you know, that’s dry “junk land.” So I’m <br />just a little hesitant on that rationale. The other thing is that, again, the green is Ag-1, right? <br />HAYASHI: Correct. <br />BOWMAN: Okay. And if the applicant would cut them into Ag-1, would they <br />have to go through a State Land Use Boundary change? <br />HAYASHI: No. <br />BOWMAN: Okay, thank you. <br />HAYASHI: Mr. Chair, I know you’re in deliberation right now -. <br />WATANABE: Yes. <br />HAYASHI: But I just wanted to point out something. <br />WATANABE: Yes. <br />HAYASHI: Some of the Commissioners may recall we did have a similar rezoning <br />back in 1997 last year for RA-.5 -. <br />BOWMAN: Two thousand seven. <br />HAYASHI: Two thousand, yeah -. <br />WATANABE: He’s trying to get younger, so minus ten years. <br />HAYASHI: Anyway, that particular property for your information is off the map, <br />but it is located right here in this general location.
