The Applicant shall secure all necessary approvals and permits from other affected Federal, <br /> State,and County agencies as necessary to comply with all applicable laws and regulations. <br /> 3. Construction and operation of the proposed residential development, office building and <br /> preservation area shall be conducted in a manner that is substantially representative of plans <br /> and details as contained within the Special Management Area Use Permit application dated <br /> August 9, 2023, and representations made to the Leeward Planning Commission. <br /> 4. The Applicant shall submit the anticipated maximum daily water usage calculations as <br /> prepared by a professional engineer licensed in the State of Hawaii to the Department of <br /> Water Supply for review and approval. <br /> 5. The Applicant shall implement any improvements required by the Fire Department and/or <br /> Department of Water Supply to ensure that fire protection requirements can be met for <br /> commercial uses prior to issuance of a Certificate of Occupancy. <br /> 6. Construction of the proposed development shall be completed within ten (10) years from <br /> the effective date of this permit. Prior to construction,the Applicant shall secure Final Plan <br /> Approval for the proposed development from the Planning Director in accordance with <br /> Section 25-2-70, Chapter 25 (Zoning Code), Hawaii County Code. Plans shall identify all <br /> existing and/or proposed structure(s),paved driveway access and parking stalls associated <br /> with the proposed development. Landscaping shall be indicated on the plans for the <br /> purpose of mitigating any adverse noise or visual impacts to adjacent properties in <br /> accordance with the requirements of Planning Department's Rule No. 17 (Landscaping <br /> Requirements) and Chapter 25 (Zoning Code), Hawaii County Code. <br /> 7. All driveway connections to Walua Road shall conform to Chapter 22, County Streets, of <br /> the Hawaii County Code. <br /> 8. No driveway connection to Kuakini Highway will be permitted. <br /> 9. All construction and maintenance activities on the subject parcel shall comply with Chapter <br /> 27, Floodplain Management, of the Hawaii County Code. <br /> 10. All earthwork and grading shall conform to Chapter 10,Erosion and Sedimentation Control <br /> of the Hawaii County Code. <br /> 11.
