LILI`UOKALANI <br /> TRUST <br /> E'ONIP,4A KAKOU <br /> Let us all be steadfast. <br /> September 11, 2023 <br /> Via email to: planning@hawaiicount-y.gov <br /> Zendo Kern, Director <br /> Planning Department <br /> County of Hawai'i <br /> Aupuni Center <br /> 101 Pauahi Street, Suite 3 <br /> Hilo, Hawai'i 96720 <br /> Subject: Request for Amendment to Ordinance No. 00-90(REZ 684) <br /> Keahuolu Ahupua'a, North Kona District,TMK: (3)7-4-015:015(por.) <br /> Aloha Director Kern- <br /> Lili'uokalani Trust(LT)is respectfully submitting this request for an amendment to certain conditions of County <br /> of Hawai'i Zoning Ordinance No. 00-90 for Planning Department review and consideration. <br /> The subject area, consisting of 0.874 acres or 38,071 square feet,was originally part of a 7.546-acre area <br /> zoned General Industrial (MG-1 a) in 1967. On June 3, 1971, a 1.403-acre area, of which the subject area was a <br /> part,was then subsequently rezoned Open(0)via Ordinance No. 400 to, among other considerations, <br /> accommodate the additional right-of-way needed for the Queen Ka'ahumanu Highway,with the remaining <br /> MG-1 a area being rezoned Village Commercial (CV-10). See Exhibit 1. <br /> As the entire 1.403-acre area was no longer needed for the right-of-way, at LT's request,the 0.874-acre area <br /> was rezoned to CV-10, similar to the balance of the property, on March 21, 1991,via Ordinance No. 91-27. See <br /> Exhibit 2.The thought was to have this area eventually developed into some commercial uses, consistent with <br /> the surrounding area. <br /> Notwithstanding the absence of any specific development plan for this site, as was customary then,time <br /> performance conditions(Conditions B, C, and D)for its development were made a part of Ordinance No. 91- <br /> 27. Condition B required the subdivision of the right-of-way,while Conditions C and D related to the <br /> development of the rezoned area. <br /> On August 21, 2000, Ordinance No. 00-90 deleted the subdivision condition as it was complied with. Itfurther <br /> provided a 10-year construction time completion window(Conditions Band C). See Exhibit 3. Ina letter, <br /> dated September 14, 2010,the Planning Director granted a time extension to August 21, 2020. See Exhibit 4. <br /> Further, since the adoption of Ordinance No. 00-90, as will be outlined below,there were also other <br /> conditions, including making some off-site infrastructure improvements per Conditions D and F,which have <br /> since been complied with. <br /> Given that development of the site was already contemplated as part of the original 1967 zoning map;that it is <br /> located in an area where the zoning is consistent with all relevant regulatory and planning documents, such as <br /> 1100 ALAKEA STREET,SUITE 1100 •HONOLULU,HAWAI'I 96813-2845 <br /> Planning Dept. 808-203-6150.ONIPAA.ORG <br /> Exhibit 1 <br />
