Zendo Kern,Director <br /> September 11,2023 <br /> 4 <br /> Further, inasmuch as the improvements to Eho Street to its intersection with the Queen Ka'ahumanu <br /> Highway, as required by Conditions D and F, have already been completed, including its dedication to <br /> the County, LT requests deletion of these conditions as well. <br /> Finally, it should also be noted that Condition K allowing for an administrative extension is no longer <br /> an option. The Zoning Code was recently amended (Section 25-2-44(c))and now states"A condition <br /> granting an administrative time extension by the director shall not be included in any change of zone <br /> ordinance." Accordingly, LT is requesting that Condition K be deleted as well. <br /> III. LOCATION <br /> The subject area consists of a 0.874-acre(38,071 square feet) portion of Tax Map Key(3)7-4-015:015. <br /> It is located in the Keahuolu ahupua'a in North Kona. The property is rectangular shaped and is <br /> located adjacent to the Kona Coast Shopping Center. More specifically, it is situated on the south side <br /> of the Eho Street and Queen Ka'ahumanu Highway intersection. The property is vacant of any <br /> structures or uses. <br /> IV. PROPOSED DEVELOPMENT <br /> LT has completed off-site infrastructure improvements to support the development of the subject <br /> parcel, essentially making that parcel "shovel-ready."As noted earlier, LT does not have the site leased <br /> to a developer at this time. However, it believes that it is only a matter of time, given the surrounding <br /> land uses and existing off-site infrastructure. When that occurs,the project would be subject to further <br /> review through the Plan Approval process to assure consistency with the remaining conditions of the <br /> rezoning ordinance as well as the Zoning Code. <br /> V. REZONING CONDITIONS <br /> As noted earlier,the subject area was initially rezoned into the CV-10 zoning district on August 21, <br /> 2000,via Ordinance No. 00-90 subject to a number of conditions. Refer to Exhibit 3.The most recent <br /> annual progress report was submitted on August 16, 2023. In accordance with this report,the <br /> pertinent conditions and updates as to their their status follow: <br /> Condition (A) The applicant, successors or assigns, shall comply with all of the stated conditions of <br /> approval. <br /> Response <br /> LT acknowledges this condition and has submitted a report on August 16, 2023,to address the <br /> status of compliance with the conditions of approval for the current year(EPIC Case no. PL-INT- <br /> 2023-005906).The report is still under review by the Planning Department. <br /> Condition (8) Final Plan Approval of the development shall be secured from the Planning Department <br /> within ten years from the effective date of this amendment.
