be applied by the commission in that we were deprived of the reasonable use of the land in that <br />the existing structures are as you can see from the photos of the ADA ramp portion. The existing <br />structure is located well towards the shoreline and this proposed addition would be well back. <br />This is a request that is unique circumstances of the public use of the ocean front area. Wed like <br />as much as possible, and I think everybody wants that to happen is to try to maintain the open <br />nature of the frontage of the yard and if any development that occurs will be backed up against <br />the existing buildings. In this particular case, we happen to be closer than the central portion of <br />the project but we believe that the unique circumstance of the existing building being somewhat <br />like 10 to 12 feet away from the shoreline in that area would mitigate against any viewplane <br />issues or impact issues. Its, you know something is there already, in other words. And this is <br />the practical alternative which best conforms to the purpose of the rules because we would like to <br />encourage the development in an area that was back up against an existing structure that was <br />already way into the shoreline setback area instead of coming back out onto the other side of the <br />project with the new development in the open lawn area. Of course the <br />Department reviews it and all and we take a look at that recommendations.
