LIM:Okay, I think its fair to require the applicant to conduct a flood study <br />were just worried that when you go in for these letter of map changes they take a year <br />sometimes and we didnt want to wait for the whole project for that. So if we, as long as Public <br />Works is telling the applicant that you can, with the Department of Public Works consent do <br />work in some areas that are clearly not impacted or not going to be impacted by the, by the flood <br />then, then thats okay with us. <br />EMLER:Well, we want the flood study done prior to any construction permit being <br />issued period. <br />ALAMEDA:Director? <br />YUEN:Yes and-. <br />LIM:MysuggestedchangeIguesswewouldjusttakethisportionthatsays <br />prior to the issuance of any construction permit and put it on to the end of the first sentence. So <br />that essentially what hes saying is we do the flood study prior to pulling any construction permit <br />and the next sentence would just reiterate if required by DPW then we submit the, the letter of <br />map change for processing. <br />EMLER:In other words were not necessarily asking for the LOMAR, the final <br />letter of map revision prior to any construction permit. What were asking is to be able to <br />evaluate it to determine whether a conditional letter of map revision is required prior to them <br />doing their land alterations. <br />YUEN:Then I would add this to the end of the second sentence that were talking <br />about here. We would, we would say, let me start from the, the only part Im going to change is <br />at the very end but let me start from the beginning. If required by the Department of Public <br />Works, the applicant shall submit the study to the Federal Emergency Management Agency, <br />FEMA and obtain a letter of map change, LOMC, prior to the issuance of any construction or <br />grading permit comma, within areas determined by DPW. And that makes it clear that DPW <br />could let them have a construction or grading permit for some areas of the property while they <br />pursue a letter of map change for other areas. I think what Mr. Lims concern is that this sounds <br />like if DPW wants a, a LOMAR then they are precluded from getting any construction permits <br />anywhere until the LOMAR is issued. Thats not what you want right? <br />EMLER:Thats correct. Thats why I used the more generic term, letter of map <br />change so that were not having to write this extensive explanation of it. But I am on the record <br />as basically going on, going along with what you just said. <br />YUEN:Mm hm. Okay. Well let me. I think to make it clear we can just add that <br />little clause at the end of the sentence. Okay? <br />EMLER:Thank you. <br />ALAMEDA:Thank you. Continue. <br />EXHIBIT B <br />26 <br /> <br />
