HOUSEL: Aye. <br />DARROW: The motion passes, six to one. <br />HOUSEL: Thank you, Mr. Darrow. Okay. The question is you made a petition for continuance. <br />Would you like to explain that to the -? <br />P. OLSON: Well, I agree that we can make this thing go a lot quicker and there is a lot of energy <br />and emotion in this whole thing, but -. <br />HOUSEL: Could you hold your microphone a little closer? <br />P. OLSON: I agree with trying to make this thing go along quicker and a lot of the stuff we’ve <br />st <br />already made a record of in our letter, on December 1we wrote a letter. We also indicated in the <br />subsequent letter to the Commission that the Kanuhas will be joining that request. And under Rule <br />4-6(e), we are allowed to have 20 days for the Kanuhas from granting of standing in this case; so we <br />would submit in our letters the Commission’s ruling today to allow Jerome Kanuha and Kanuha <br />‘Ohana standing, I mean just to incorporate the arguments therein. <br />HOUSEL: Now, you’ve submitted documents already as a joinder, right? <br />P. OLSON: Correct. We formally joined the Kanuhas in the request for continuance, and we’ve <br />st <br />already documented that the reasons for our request in December 1 letter to Mr. Chair, and again in <br />following letters in response to Mr. Yeh Kanuha’s joinder in the request. <br />HOUSEL: Okay, so, are you -. <br />P. OLSON: I can reiterate it for you. I’m just trying to save time. You guys have our reasons. I <br />can go into them, if you want me to. I’ll do so, if you -. <br />HOUSEL: I think I’d like to ask Mr. Yeh his position on this. <br />YEH: I think, you know, the Commission having determined standing presumably under Rule 4- <br />6(e), then if you’re going to apply that part of the rule, I think it then means that this 20-day <br />suspension period applies. So, you know, be that as it may, that’s probably where we are at this <br />juncture. Now, there is a hearing scheduled tomorrow, but I’m not sure what’s going to take place <br />at that time. <br />HOUSEL: Okay. Could I ask the Planning Director her position on this? <br />YEH: And while we are talking about it, I mean, you know, from a precedent standpoint I think the <br />general concern probably is, from our part again, is, well, what’s to stop someone from coming in <br />next time we convene. So that’s just the overall issue that we have. <br />HOUSEL: I understand, yes, I understand. <br />P. OLSON: Mr. Chair, if you want me to go into my reasons for the continuance as well for the <br />record, or are you comfortable with what I’ve already written? <br />30 <br />EXHIBIT D <br /> <br />
