<br />LEITHEAD TODD: Mr. Arai, February 16 the County Council is meeting at the Sheraton

<br />Keauhou Bay Resort; it is scheduled on the 16 for the County Council in February.

<br />HOUSEL: So the 16 would not be available, is that correct?
<br />ARAI: Normally, the Director makes herself available to the Council.
<br />LEITHEAD TODD: That’s okay. I can send a surrogate.
<br />ARAI: There you go.
<br />HOUSEL: Okay, wonderful, wonderful. Well, I’m hoping that we can get this taken care of. I
<br />guess I wanted to just confirm that, now, we, as far as I know, have not had a response from, on the
<br />AIS,from the State Historic Preservation Department, is that correct?
<br />YEH: As far as I know – now, Dr. Haun was going to try to explain today, but maybe next time –
<br />he has been in correspondence with Theresa Donham and she had a few questions, and I think he
<br />was able to answer them hopefully satisfactorily. But we’ll see, you know, because the comments
<br />haven’t come out. As we pointed out before, there really is supposed to be a 45-day period, and
<br />maybe this time will allow her to come with some final comments perhaps –I think that will be the
<br />case.
<br />HOUSEL: And you believe that we can get the cultural impact assessment issues addressed also?
<br />YEH: Well, you know, thank you for the opportunity to talk about that, because the cultural impact
<br />assessment report that we provided to the Commission is really not a mandated report that SHPD
<br />even has jurisdiction to approve. Now, we did out of courtesy send it to SHPD to provide comment,
<br />which they did. Tomorrow, we were going to bring the CIA person to explain why those comments
<br />really are not, No. 1, either legally mandated, No. 2, consistent with the OEQC guidelines even if it
<br />was a mandated report and, No. 3, to explain her methodology. But I think between now and
<br />February, we should be able to clear up some of those things, too.
<br />HOUSEL: Okay, hopefully. Thank you, thank you.
<br />P. OLSON: If I may respond, I just respectfully would object to the characterization of the law, and
<br />I can reiterate that at another time;but we object to the characterization.
<br />HOUSEL: Okay, thank you. (After a quick consultation with Mr. Gonzalez,) okay, get everything
<br />in the right order today. Was there a motion made to continue? I think we need a motion, right?

<br />HOUSEL: Our intent is, because the Commission has committed to take public testimony
<br />tomorrow, okay, even without the evidentiary presentation we would like to continue the public
<br />testimony tomorrow. And you are certainly welcomed to be here, if you choose.
