Mr. Chair, I move for the acceptance ofGary <br />Washburn€s Petition for Standing in a Contested Case Hearing on this matter of David <br />and Sharon Pettus, Applicants for a Special Permit No. 04-010. <br />FUJIKAWA:Is there a second? <br />MCCALL:Second. <br />FUJIKAWA:It has been moved by Commissioner Springer and seconded by <br />Commissioner McCall that Gary Washburn€s application for a contested casebe <br />accepted. <br />SIRACUSA:Excuse me. Can I ask for clarification? <br />FUJIKAWA:Okay. Asfaras the ƒ go ahead. Wait a minute. Siracusa? <br />SIRACUSA:We€re not talking about two separate contested case hearings,are <br />we?OneforMs.GreenandoneforMr.Washburn? <br />TORIGOE:Justtwointervenors. <br />SIRACUSA:Just two intervenors. Okay. I just wanted to clarify that. <br />FUJIKAWA:Yeah. Mr. Torigoe? <br />TORIGOE:Again, just for the record. The Applicant is taking no position with <br />respect to the granting of standing to these two intervenors. <br />LIM:That€s correct. <br />FUJIKAWA:So there had been a motion made. Any questions? Alameda? <br />ALAMEDA:Real quick, then, for my own -. So does that mean then if we <br />grant, if we approve standing, then we wouldn€t be voting on it today? It will be moved <br />forward for a mediator type of case? <br />YUEN:That€s the next step. Then after taking the votes on these two <br />individuals, then the Commission will, should have a discussion about whether you want <br />to proceed today, you want to hire a hearing officer, you want to hear it yourself.
