HOUSE OF REPRESENTATIVES <br />TWENTY-NINTH LEGISLATURE, 2018 <br />STATE OF HAWAII <br />H.C.R. NO. I'82 <br />HOUSE CONCURRENT <br />RESOLUTION <br />URGING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO WORK WITH <br />LOCAL HUNTERS TO ACCOMMODATE TRADITIONAL AND CUSTOMARY <br />NATIVE HAWAIIAN HUNTING PRACTICES AND CHANGE ITS POLICIES <br />BASED ON THE CONCERNS OF LOCAL HUNTERS. <br />1 WHEREAS, the powers and duties of the Department of Land <br />2 and Natural Resources (DLNR) pursuant to Chapter 183D, Hawaii <br />3 Revised Statutes, include managing and administering the <br />4 wildlife resources and enforcing the wildlife hunting laws of <br />5 the State; and <br />6 <br />7 WHEREAS, Article XII, section 7 of the Hawaii State <br />8 Constitution, acknowledges the State's obligation to protect all <br />9 rights, customarily and traditionally exercised for subsistence, <br />10 cultural, and religious purposes and possessed by ahupua'a <br />11 tenants who are descendants of native Hawaiians who inhabited <br />12 the Hawaiian islands prior to 1778, subject to the right of the <br />13 State to regulate such rights; and <br />14 <br />15 WHEREAS, the Legislature passed Act 210, Session Laws of <br />16 Hawaii 2016, that established the Game Management Advisory <br />17 Commission (Advisory Commission) within DLNR, that recommends to <br />18 the Board of Land and Natural Resources (Board): <br />19 <br />20 (1) Policies and criteria regarding the management, <br />21 protection, and promotion of public hunting in Hawaii; <br />22 and <br />23 <br />24 (2) Amendments to existing DLNR policies and procedures <br />25 relating to hunting; and <br />26 <br />27 WHEREAS, each member of the Advisory Commission, except the <br />28 Chairperson of the Board, is required to be a licensed hunter in <br />29 Hawaii and have leadership experience in working directly with <br />HCR HMS 2018-2651 <br />1 <br />
