§ 13 - 6 0 . 4 - 5 <br />Division of Aquatic Resources West <br />Hawaii (DAR-Kona) office prior to <br />sunset. The notification shall include <br />the names of individuals who plan to <br />possess the gear or aquatic life and <br />the location where the possession will <br />take place; <br />(B) Without holding a valid West Hawaii <br />aquarium permit issued pursuant to <br />section 13-60.4-7(a); <br />(C) In violation of the terms and <br />conditions of a West Hawaii aquarium <br />permit issued to that person; or <br />(D) While occupying any vessel that does <br />not conform to the registration and <br />marking requirements of section 13- <br />60.4-7(d); <br />(4) Possess or use any net or container employed <br />underwater to capture or hold aquatic life <br />alive for aquarium purposes, that is not <br />labeled with the commercial marine license <br />number or numbers of the person or persons <br />owning, possessing or using the equipment; <br />(5) Possess a lay net or engage in lay net <br />fishing in violation of the requirements of <br />section 13-60.4-6; or <br />(6) Engage in or attempt to engage in SCUBA <br />spearfishing, possess both SCUBA gear and a <br />spear at the same time, or possess SCUBA <br />gear and any specimen of speared aquatic <br />life at the same time.
