Public Access is available via <br /> sidewalks (existing and proposed) located around the subject parcel. As this is not a <br /> shoreline parcel, there is no direct access to the shoreline. <br /> 5. Kona Community Development Plan (KCDP): The Kona Community Development <br /> Plan (as amended) was adopted by the Hawaii County Council by Ordinance No. 19-91 <br /> on September 18, 2019. <br /> 11. Special Management Area (SMA): The subject properties are situated fully within the <br /> SMA, however, it is not a shoreline parcel pursuant to HRS 205A. <br /> BACKGROUND INFORMATION <br /> 12. December 3, 1998: SMA Use Permit 98-7 (SMA No. 388) was approved for the <br /> development of a resort condominium/office complex consisting of 48 2-bedroom resort- <br /> condo units, commercial and retails space. <br /> 13. January 31, 2002: Time Extension was granted by Planning Director to December 13, <br /> 2008, for SMA 388. <br /> 14. June 6, 2007: Final Plan Approval was issued for a 45-foot-high structure with 20-foot <br /> setbacks, 115 parking stalls, and three (3) loading stalls.
