I. Call to Order
The meeting was called to order by Chair Nishimoto at 9:58 A.M., in the Kona Meeting
Room, Department of Liquor Control, Hanama Place, 75-5706 Kuakini Highway, Suite 107,
Kailua-Kona, Hawaii.
The following were present and constituted a quorum:

Cui: Yes, actually you know this garden is a 23-acre tropical garden with almost 20,000
square feet of building is zoned commercial for restaurant, so it's well known in Hilo
area. A lot of local people love to go there have parties, have the meetings, so that's

why we really want to bring all this back to the community, so we want to have this
liquor license to serve the people, so that's what we do.
Nishimoto: Have you received the application report?

Nishimoto: Director, are there any reports of protests?
Takase: Madame Chairman, the applicants mailed 17 out of 17 notices within 100 feet,
34 out of 34 within 500 feet. There were 34 properties entitled to protest, we received
no protests to the application.

Nishimoto: Could you please describe your business.
Jones: We're country-themed, we'd like to do a sports bar and grill, we kind of focus on
live music and dining with dancing, just kind of good local food, good local entertainment,
and something different, themed nights. We just kind of want to just kind of create a hub,
family atmosphere, we'd like to promote also sports. We're going to have a bunch of
screens, so that's kind of the gist of it.
Nishimoto: Did you receive the application report?
Jones: Yes.
Nishimoto: And are there any changes to the report?
Jones: No.

Espejo: I got a question on your name, you have Marzo on there?

Jones: Ikaika Marzo is one of my best friends.
Espejo: Oh, okay.
Jones: So, he'll be working for me, and he's kind of going to draw the talent and of
course, he's really talented himself.
Espejo: Yes.
Jones: So, you know we always go around watching him play every place he goes, so
we might as well have someplace he can call home.
Espejo: Nice.
Jones: So, it's named after him, Ikaika Marzo.
Espejo: Thank you.
Nishimoto: And I understand it's "Bottoms Up Beer", and it's the first in the State,
would you like to share a little bit about that?
Jones: Keenan can fill you in on that, that's kind of his thing,
Lee: So, ten years ago, I was in Las Vegas, and I saw this contraption, I was super
interested, I talked to just the bartender there, he explained. He made eight beers in
seconds, basically I reached in my wallet and all the eight beers were in front of me.
So, I was like, what? He was there by himself, so I was like, he didn't get no help.
And he was like, "Oh, this new system just came out, it started at UNLV (University of
Nevada Las Vegas), the inventor is from Indiana." So, I ended up doing research and
bought into the company immediately, being that you know, I never seen it anywhere
traveling, I never seen it. Basically, normal keg yield is 70% because of the spillage,
overpouring, foaming, and what not. With this system, it's 95% keg yield, so you gain
that much more, and that kind of piqued interest, what I was thinking with all this waste,
save money. Unfortunately, I got into a career where I could no longer run the
business, so we kind of shelved it for my kids, and now I have an opportunity to bring
it back. I'm super close with the creator of the business, and he's excited to come to
Hawaii. So, this is just an opportunity that popped up in my connections, I talked to
Nakoa in the past about it, and you know there's ways we can get this to Hawaii. And,
being the first one on the Big Island is going to be really good I think, if the opportunity
presents itself.
Takase: Why don't you explain how it works.
Lee: Basically, they have their own receptacles, metal ring on the bottom, magnets,
basically you can put any advertisement on the magnets. Basically, it sits just on the
magnet, and once you place it down, it pushes the magnet up, fills it to a setting that we
set, and then as you pull it off, it'll seal it back up. So, when you see it in action, I sent

the video to someone, and I think they shared it. So, super simple, I mean it seems like
it's futuristic and all of that, but it's really just a piston that fits, and then you know, you're
no longer slaving, basically you're not slaving there all day doing this, trying to get the
foam out, you just leave it, go help the customers ring up a bill and get back to your
beer. So, I think it's a great concept ten years ago, so you know it just didn't present
itself at the time.

Takase: I have one more question, you have a, kind of behind your dance floor area,
looks like another room?
Jones: Oh, that's an elevated platform, it's a six-inch elevated platform with railings
around it.
Takase: Oh okay, so it's enclosed?
Jones: No, it's not enclosed, there'll be railings, it's just kind of gives a little more
exclusive area, or if we're not that busy, we can close that section and just kind of focus
on keeping everything in one area, and you got a little better view looking over people.
Takase: Okay, thanks.

Espejo: When is the expected opening?
Jones: It just depends on how everything plays out, but I mean we'd like to get by
mid -year sometime, that would be awesome. We got to just roll with it and see how
we go, come through here, and then of course County, and Fire and everything.

plant, and I'm building another greenhouse to supply the kitchen. The problem with
what I'd like to do to expand right now is our kitchen is big, and if I can section it off for
increasing the liquor license, and then the coffee shop, where we can have take -away
food already prepared in the coffee shop, that will let me increase my hours, and not
have the whole property open at one time. Also, my goal is to serve the community with
lunch and dinner, we have brunch on Sunday, we have limited hours right now because
we're training staff, learned that kitchen staff, so we've recruited young people which we
have a great chef, and he's training. We'll be able to stay open longer because we'll
have pre -made food in the coffee shop, and I'll section off the other side that's large,
and have that for more formal dining in the evenings.

but I'd like to get another maybe 15-20 acres to plant.

Lawrence: No, no, well the restaurant detoured me from planting the coffee, I got so
busy working on the restaurant, that I stopped working on the other property, so you
know, it's been challenging getting this restaurant and the property up to the level that
want it at, I've been working on it for 2 �/2 years, and it's absolutely gorgeous. I'm
providing an upscale experience I feel like in the jungle up there, and having big
growing beds that we're putting tomatoes in, got the hoop house and I've put an outdoor
area that I call the internet lounge that people can come and get on their computers and
work and have a cup of coffee, not just booze, you know? I get a lot of people in the
morning that come up because they don't have internet up there, and it's beautiful
gardens. But, to support that kitchen, and open that big kitchen up and staff it is a
challenge, so having this liquor license in the coffee shop, I can section off the internet
lounge, and around the monkey pod tree, and not have the big kitchen open, where
can pre -make take -away food, take -away salads and so forth that people can grab and
either get a mimosa, a beer, or a cup of coffee and enjoy the gardens.

Moore: So, we are a non-profit, and the event that we are applying for a Class 10
Special permit is for tomorrow night, it's a concert. We're partnering also with one of the
largest production teams in the entire State whose responsible for bringing huge acts,
musicians over from the mainland, they do concerts over at the Shell and Blaisdell on
`O`ahu, and they're partnering with the foundation to bring Brett Young over tomorrow
night, over to the Brew. So, we're very, very excited for this opportunity to work with
these very seasoned professionals who have been doing this for over 30 years, and to
have access for the people that live here, to such world class musicians.

Moore: Absolutely, thank you for the opportunity to do that. Last year, we did have a
mixed area, right? The infrastructure was not in place clearly to help support that
environment, so this year we made some very clear distinctions and remedied the

situation by providing two separate areas for consumption, and also for general use
area. Furthermore, it's separated by a minimum of a five-foot barricade. We are

coming over, and we're increasing the amount of security guards to 37, so there will be
37 on -site tomorrow. In addition to that, we are partnering with Kona Brew, and using a
very well -seasoned blue card team. Mattson is also working with an event coordinator
that has been doing events on that specific piece of property for many years, so we are
trying to do everything we can to meaningfully address any shortcomings that we had
last year.

about marijuana use, and you know I realize that people can have medical marijuana,

got. I think it was actually your own security was saying that they were trying to stop it
but they were being told that if they have a marijuana card, they're allowed to have it
and use it. And, I guess I wanted to reiterate not only our position, but the law
enforcement's position is that you know, you can have medical marijuana, but that's
really for private use at your own residence, so if you can take it out? So, you know
guess we're going to expect you folks to reinforce that position, because your security

said they would help take care of it, but they were told to not bother last time, and there
seemed to be some mix up as to whether they could or not.

Moore: This year, the dispensary is closing early, they won't even be open, it's not going
to be an issue, and to address last year in all honesty, and I'm a pharmacist, I've been a
pharmacist for 20 years, I have a Doctor of Pharmacy, all I was simply acknowledging is
because there was a dispensary on premises, that their patients have certain rights, and
that I was not in a position to say legally what to enforce or not, that if the liquor inspector
wanted to have that directive to the security team, no problem, but that I was not a lawyer
and I did not want to get into any kind of legal discussion about it. I just didn't feel like it
was my place to be honest with you, but we completely mitigated that by just having the
dispensary and that team, it's closing early, not closed for the whole day, so hopefully that
addresses that concern, sir.

Nishimoto: Discussion of the motion?
Wilkinson: Commissioner Wilkinson, we have almost always approve these, and most
of the rationale has been because the reason for the delay has been out of their control,
and I understand that they're saying that they're ready, but the reason for the delay has
been that they aren't for the most part. Even the first one was they didn't have the staff
in place that they were confident with, the second one was because of the parking
structure in the Coconut Grove, it decreased their income, so their decision to move on
that is again of their own choosing. So, I just want to make sure that we're applying the
same standard when we approve these, that we are across the board. Can I ask, what
would happen if we don't approve this, do they just have to start over?
Takase: Yes.
Wilkinson: And how far have they come?
Takase: They've been approved for a license already, they just trying to get through
final inspections, so it's a little bit different than the normal ones because most of them
are waiting for County approvals, which they don't seem to be so much in this case.
But I think part of the past time was spent on that part, so they're kind of ready to move.
This one seems to be talking more about their financial crisis, whether they should
move forward or not.
Wilkinson: So, can we condition the approval that it's just one, unless good cause
appears that it's out of their control for an additional extension?
Takase: Yes, we can.
Wilkinson: Just to make sure that if they choose to move forward, and anything that
would allow us or convince us to approve an additional extension, it would have to be
out of their control, or something like that?

six months extension just for a final fire inspection. In other words, we gotta give six
months for the Fire Department to come out here and do an inspection, now that's kind
of anti -business, isn't it?

Greenwell: Yes, we kind of trapped like we've been so many other times where people
are looking for an extension just to get through building processing, or building
permitting, and all they're waiting for is a fire inspection, and we're going to give them
six months?
Nishimoto: Do they even have it scheduled, I don't even know?
Greenwell: Just food for thought, just talking.
Takase: Yeah, so hopefully within the next six months, Fire can get out there and do
their inspection. We could make it shorter, but then it's almost like we're penalizing
them and ourselves because it keeps coming up.

Takase: Yeah, I don't think that's unreasonable, even though things aren't moving that
quickly.
Greenwell: I don't know, I'm just saying it just seems like for a fire inspection, we're
going to give them a six-month extension, maybe the Mayor needs to hear about this,
don't know.
Takase: The Mayor is touting how fast everything has become.

building, the Commission doesn't go and go out of their way to try to see to speed up
the process, right?
Takase: No, and we've kind of stayed away from pushing it.
Okabe: It's the business responsibility to contact the County, right?
Takase: Yes, and they have, before you use to just call for them, but now you have to
go through the EPIC (Electronic Processing Information Center) system, so you do
everything electronically now, so you go right in, and you get queued in. And then,
think it's not high on the list because it's kind of like, you're in operations so what are
you guys worried about? They're trying to get through houses and things of that nature,
so it has kind of dragged on, it shouldn't be that way, because I suppose if we starting
denying them, then we'll create a big huer. And then, they're going to come back to us
and say why don't we just approve it? So, we're kind of back where we were, so it's
bad, yes we kept waiting, but I don't want to insert ourselves as the most important out
there, and we've got two former managing directors, they can appreciate the managing
part of it.
